RECOMMENDED MERCY. (Continued From first Page.) said : Trump came from hallway in Dunlap building and said "I have made my point. I am a good detective. I have got the people locked up" and I said "I suppose you will go and lock yourself up" and he said "that Is what I am going to do." Wc walked up street together and I left htm and he wcht in the direction of Harry Clark's home. Charles Steele Followed Trump up the stairway when he went to the telephone. He called up a number and said "Harry is in the gallery, the other party will be there in a minute. Chas. Stonmeker Trump came from the hallway after telephoning and said "I saw Forest Hayes go Into the gallery from the window." Oswcll ? Caldwell Said that Mrs Taylor and Helen lied if they testified that Helen did not tell him when he served the subpoena on her "I don't know anything about this, they all went into the back room and left mc In the front." Mrs. John Oswald That after thl. alleged offense Trump and Mrs Clark met at her house twice and that Mrs Clark sat in his lap and that he put his arms around her and caressed and kissed her. That she ordered them from the house boh times and that each time they went out the back door. Mrs. Clark told her that she was going to get a divorce from Harry and go and live with Trump. If he could get a divorce they would get married and if he couldn't she would work In his gallery. STATE RESTED. J. G. Whlttakcr opened the case for tnc state and Prosecutor Smith closed it. Coke L. Dos-tcr opened for the defense and D. Q. Morrow closed. The case went to the jury about 4:30 Monday afternoon and they arrived at a verdict about 0 o'clock Tuesday morning. They' found the defendant guilty of rape with consent and recommended him to the mercy of the court. Col. Morrow made a motion for a new trial. The minimum penalty for this offense Is six montbB in jail and the maximum three years in the penitentiary. The general impression seems to be that the verdict Is absolutely just as Clark is thought to have been the victim of the machination and schemes of Trump and his wife and he had the general sympathy of all who heard the testimony.
