Tlie Jeaf and C. I. T. Co. Settle. In the office of the circuit clerk were filed the articles of agreement entered Into between the Clover Leaf railroad company and the Mattoon city . railway company, successor t'j the Central Illinois Traction company, concerning a right of way for the Charleston-Mattoon interurb-in tracks under a trestle on the Clover Leaf at Cossell creek, west of this" illy. By the terms of the agreement th'? Clover Leaf, within sixty days from January 27, 1903, is to make an opeti- lng ln the trestle for the tracks of the Interurban company, and this opening is to be temporarily bridged with timbers. This is to be replaced as soon as possible with a concrete and masonry structure at the cost of the railroad company. As a consideration for Jhe right to cross the tracks and as damage to the trestle the Mattoon city railway company is to pay the Clover Leaf company the sum of $4,150, as soon as the opening is made in the treatte. It will be remembered that the traction company brought condemnation proceedings in the circuit court In this county to secure the aboe right of way, and that a jury awarded the railroad company damages to the amount of $100 for the land used and ln addition the traction company was required to stand the expense of repairing the trcatle. As a masonry and concrete arch is conceded to be the only practical manner of bridging the ixosslng, Uhe sdttlenrent made by compromising according to the above agreement, it Is considered fair to both parties, and tedious litigation la avoided. matter
