Weunore, recorder of conveyances and mortgages for the parish, of Orleans, to show cause why he refuses to record an act of sale of real estate passed before John Cragg, notary public for said city, as be is required to do oy law. The Registrar denies that Cragg is a notary pnblie, his office having been vacated by an act of the Legislature of 1857, Cragg contends contends that no successor has been appointed to him. and that, under the constitution itself and the laws, he holds and exercises hia office nntjl his successor shall be appointed and duly qualified according to law. A writ of manda - mns iasned - from the Court, and the ease will .be tried on Saturday. .
