5 IV THE CIRCVIT COVRT The case of Mary J. Heffron against John Treber. and others, in which the plaintiff sought to recover damages damages for the neglect of the leases of the Combination theatre to replace a wall which had been torn out during the time that building and the adjoining adjoining one were being operated in conjunction, came to a close In the circuit court yesterday. John Treber was tn no wise directly connected with the running of the theatre, but the suit was instituted against him as surety for John Ryan. The jury found that an agreement had been made by the defendants to replace the wall and rendered a verdict for the plaintiff in the sum of $200 and interest, amounting to $30. Another suit in which Mrs. Heffrou is the plaintiff and John Treber the defendant was taken up at the con clusion of the damage suit and was in progress at the adjournment of court last evening. This is a case in which Mrs. Heffron is suing John Treber as guarantor for rent due on a leae of the Combination theatre building. It is for rent for part of the month of September and for October, November and December, 1904. The lease was made to Riley and Ryan, with John Treber as surety. The defendant claims that he is not liable for the reason that the original lease was made to Riley and Ryan, but that Riley never took possession, his place in the partnership having been taken by one Fincher.
