In the Supreme Court, a case was tried ia which George W. Vandenburgh, a eartmeo, was plaintiff, and the Harlem Railroad Company defendants. The action was brought to recover damages for in juries received la consequence of a collision, which occurred in March last, la the Bowery, near Broome street. The plaintiff was on the track, and while endeavoring to get off, to enable the cars to pass, they ran Into him, throwing him off and dlslecatlng his shoulder. On the other hand it waa urged that tbe cars were moving very slowly, and that the driver did all ia his power to avoid a collision, which resulted entirely from the carelessness of the plaintiff. The jury found for the plaintiff damagea of one hundred dollars.
