"We filed an application with the PUC (Public .utilities Commission in Harrisburg) two weeks ago last Tuesday." Tose said. "We want to immediately purchase 750 new cabs, radio controlled, to operate in the metropolitan Philadelphia area." he said. The idea. Tose continued, is to hire veteran drivers for the strike plagued Yellow Cab Co. of Philadelphia, and to start a-, new company. There- is "no way" " they would buy the Yellow Cab Co.. Tose continued, because it has too many problems. "For one thing, the company has too much debt." he explained. "And its cabs are in poor condition." The Tose application, according to PUC spokesmen, was filed .by Leonard Tose of Pennsylvania. Inc.. a corporation. Sidney Forstater signed the application as president. Forstater is vice president of- the Eagles and an executive of the Tose Trucking Co. Barness could not be reached to confirm that the application had been made. "Herbert Barness is not in this office very often." ex- plained a spokesman. "Even if he were I don't think he would want to comment on this. I cannot confirm whether this is true, myself." Supreme Court May Gef Suit- By MARYAXX BIRD Intelligencer Special Writer The Bucks County Legal Aid Society's case against the zoning codes of the 54 county municipalities is apparently on its way to the United States Supreme Court. David H. Moskowitz. author of the suit, said he was in Washington, J. C. Friday seeking information on filing a high court appeal. "I'm almost certain we will fiie." he said, adding Legal Aid officials are "weighing the possibilities" in anticipation of an/"end of September" filing date. The suit, which charges Bucks County municipal zoning c o d e s d i scriminale against low-income persons. was dismissed two weeks ago without a hearing by the state Supreme Court. Moskowitz. a consultant to the Regional Housing Legal Services Agency, said Legal Aid has 90 days from the date of the Pennsylvania Supreme Court rejection to file its appeal in Washington.
