A SERIOUS MISTAKE. I'hIUIps County Cltiiens Are Unable to Under- stand lluw it Was Hade. To the Editor of The Gazette. Helena, Auk., Ootober 25. In your issue of the ISth inst. appeared a letter from Gov. Fishback, in which he stated that he was in receipt of a letter from J. C. Shell, of this county, containing the statement that he (Mr. Shell) and Mr. Leon Berton, had, on the 11th of September, presented to County Judge R. W. Nicholls, eviienoe of their appointment as members of the Board of Equalization, but that Judge Nicholls refused to permit them to qualify because they did not have a commission. In your issue of the 21st Inst, you published a letter from Judge Nicholls, which gave the lie to this assertion, and showed exactly where the trouble lay. Since then, as it was a matter reflecting on him as an official, JudgeNicholls has fortified himself with the following documents which show beyond any kind of controversy, not paly that Phillips County has not been provided with a Board of Equaliza- t tion. but that the Governor and his i n ' j i - m:m oecretarv uu uut ucu uu mw the details of their office business. Dbar Sir: Answering your let ter of yesterday, will say that I am positive that I neve,r received notice of my appointment as member of the Board of Equalization for this county. I was told Dy several parties tnat I had been, or would be appointed, but further than this I know noth ing of it. I served on the Board of Equalization under the administra tion ol Gov. J. 11. iserry. tne Board was then commissioned with seal oi State r.fflxed. I presume the statutes of tho State will give full direct ons as to how and w en the Boards of the respective coun ties shall be appointed and when to meet, but I have not now a copy of the statutes. To Whom It May Concern: This is to certify that neither pri or nocmbsequsnt to September 11 1893, nor at any time iSy-cnived any notification from the Governor, his Secretary, nor the Secretary of State, nor from anyone else that I had been appointed as a member of the Board of Equalization of Phillips County. Nor did I, on the llctv of Septembe r, 1893, present myself to the County Judge or County Clerk and offer to qualify as sue a. 1 had no notice of appointment to exhibit. Leon Berton. A Gazette reporter, has endeavored to see Mr. J, C. Shell, who. as alleged by Gov. Fishback, wrote that gentleman that he had presented his notice of appointment to Judge Nicholls in company with Mr. Berton on the day appointed by law for the Board to meat, but has not yet been able to see him. It is evident that a serious mistake has been made by somebody, as JudgeNicholls and County Clerk Rembert both positively deny that Mr. Shell or anybody else exhibited any notice of appointment or offered to qualify as members of the board. .
