SETS APART $100,000 FOR CHARITY FUND Capt. Jas. Garitty Sets Aside $100 000 for Noble Purpose—Trustees Are Prominent Citizens. CAHT. JA6. uakitty rived from said fund among said persons persons who shall meet the requirements requirements thereof, but none of said fund shall be expended outside of Navarro County, Texas, said objects of charity to be selected by said trustees, their survivors or successors, or under their direction. Fifth.—Said charity fund and the distribution of the interest and in come therefrom shall always remain under the control and direction and management of said Trustees, their survivors and successors. Sixth.—Said Trustees, their survivors survivors and successors shall hold their positions and offices for and during the term of their natural life. I reserve, reserve, however, the right to, and shall he glad to, participate in the counsels of said Board of Trustees, in the control, management and distribution distribution of said fund. Seventh.—Should any vacancies occur occur in saj|fl Board of Trustees by death, resignation or otherwise, during during my life, then I reserve the right to till such vacancy or vacancies. After After my death any vacancy in the Board of Trustees shall be filled by vote of the surviving Trustees taken by ballot, and shall require at least three votes out of five to elect, and said Trustees may incorporate for that purpose. Eighth.—The action of said Board of Trustees, their survivors and successors, successors, in the management, control and distribution of said permanent and available funds, herein provided for, shall be subject to examination of the District Court of Navarro County, Texas, for the purpose of preventing preventing and redressing any mismanagement, mismanagement, waste, breach of trust, or misapplication or division of said charity fund. Ninth.—Said Trustees, their survivors survivors and successors, are expressly forbidden to execute or permit any lien, incumbrance, debt or mortgage to be placed upon any of said property, property, the permanent fund, or the income income or revenues thereof; and it is my desire and I so direct that the entire property shall always be kept free from debt. Tenth.—Said Trustees, their survivors survivors and successors, shall not receive receive any compensation for their services; and any member of said Board of Trustees may be for sufficient sufficient cause removed, but such removal removal shall not take place except by vote of three members out of the five Trustees, and only upon written charges preferred against such mem her. Eleventh.—Full authority and power power is given to said Trustees, their survivors and successors, to formulate, formulate, frame and enforce such by-laws, rules and regulations for the control government, management and distribution distribution of said fund, as they deem best, said Board of Trustees may employ employ at a nominal salary, a secretary for said Board, and for that purpose 1 suggest my nephew, J. N. Garitty, as the first secretary. Twelfth.—Said Board of Trustees shall make a statement each year, on or before the first day of May, under oath and in writing, showing-the receipts, receipts, disbursements, the condition and status of said fund; and said statement shall be filed with the Clerk of the County Court of Navarro Navarro County, and shall be kept in his office subject to the inspection of the public. Thirteenth.—I direct that the account account of this fund shall be kept and carried at the First National Bank of Corsicana. Texas. Fourteenth.—The office of said Board of Trustees shall be maintained maintained in Corsicana, Navarro County, Texas, and its business shall be transacted transacted in said city. | Fifteenth.—To Have and to Hold tin I to them, the said, C.
