After my death any vacancy in the Board of Trustees shall be filled by vote of the surviving Trustees taken by ballot, and shall require at least three votes out of five to elect, and said Trustees may incorporate for that purpose. action of said Board of Trustees, their survivors and successors, in the management, control and distribution of said permanent and available funds, herein provided for, shall be subject to examination of the District Court of Navarro County, Texas, for the purpose of preventing and redressing any mismanagement, waste, breach of trust, or misapplication or division of said charity fund.

Trustees, their survivors and successors, are expressly forbidden to execute or permit any lien, incumbrance, debt or mortgage to be placed upon any of said property, the permanent fund, or the income or revenues thereof; and it is my desire and I so direct that the entire property shall always be kept free from debt. Trustees, their survivors and successors, shall not receive any compensation for their services; and any member of said Board of Trustees may be for sufficient cause removed, but such removal shall not take place except by vote of three members out of the five Trustees, and only upon written charges preferred against such mem her. authority and power is given to said Trustees, their survivors and successors, to formulate, frame and enforce such by-laws, rules and regulations for the control government, management and distribution of said fund, as they deem best, said Board of Trustees may employ at a nominal salary, a secretary for said Board, and for that purpose 1 suggest my nephew, J.
