] PETER HESS ASKS CASE BE DISMISSED Peter Hess, accompanied by his son and Houston Cotner of Viah, appeared appeared before County Judge Brockman, July first and requested that the case against Jack: McClanahafl(, Houston Cotner and Sam Waters, charging robbery, robbery, be dismissed.. Judge Brockman has filed disqualification disqualification inj the case, and It will be necessary that another Judge be ap- poitned to render the decision. Following is copy of the statement of Peter Hess, which is self explanatory: explanatory: . I Statement of Peter Hess I Sallisaw, Okla., July 1, 1937. I am the Peter Hess that was the A {sign ing I complaining witness in the case of \ state Qf oldahoma vs Jack Mc . to Clanahan, Houston Cotner and Sam Waters. Some one robbed be of $103.00 on the 5th day of May, 1937 and these three men > were charged with the crime. In a preliminary hearing before before Justice of the Peace W. D. Garrison Garrison of Vian, the case was dismissed. The case was re-filed In the County Court. I hereby request Ed J. Armstrong, Armstrong, the county attorney, and the \ Honorable J. T. Brockman. county be be for J. E. Silas Judge, to dismiss this case against these three boys. I do not know who robbed me and I do not think that these three boys did it. As I told my bpy; Chester Hess, Jack .McConnell, Mary Smith and several others on the evening I was robbed, I did not know who did it, but thought It was a couple of Indians. There was a letter printed' in the Mall Bag of the Muskogee Phoenix written by some Vlan citizen which stated that I had positively identified these boys, whoever wrote that letter was mistaken because I did not positively identify these boys and I would not swear that they robbed robbed me.
