The affidavit, furnished to Hurritt A; Burrit*, Df Hancock, attorneys for the defend* ant ,is as follows: “Albert St. Cyr, of the city of Marquette, county of Marquette, ami state of Michigan, being first duly sworn deposes and *ays: “I am a train conductor In the em- ploy of the Marquette, Munlsing & Southeastern Railroad company for several years. At present, and for a number of years past I have been running a train, daily with the exception of Sundays, between Mar* quette, Michigan and Princeton, Mich- igan, mnking a complete round trip eaeh day. 1 leave Marquette In the morning and return in the evening On the return trip to Marquette from Princeton, my train is known as train No. 12 and 11. I leave Princeton at 2:40 p. m. o’clock, and arrive at Little Lake, Miehigan ,at ten minutes after 3 o’clock and then leave Little I ake for Marquette at 5 o’clock in the afternoon.
