I Under the new Criminal heading of Criminal Homicide Thomas, 25, had been charged with first degree and second degree murder in addition to voluntary manslaughter. York Judge George W. Atkins Atkins Jr., postponed sentencing pending the filing of motions by the defense. IN A RAGE? First Assistant District Attorney Morrison Williams hi his summation to the jury argued strongly that if the was able to determine that Thomas was in fear, and in such a rage and state of that he didn't know what he doing when he first hit with a pipe or shovel, Thomas by his own testimony, then, had from 5 to 15 after he left Funston lying on the floor to go downstairs and get his faculties together. Attorney Williams argued that instead Thomas got a switch blade knife, and when he heard Funston moan he went back upstairs and stabbed him 17 times. There was nothing left to fear the second he attacked the older man, local .,, Williams was said, lying since Funston on the floor, barely moving. MUCH FEAR Defense Attorney John R.
