The President and Board of Supervisors of Madison county, Miss. I). 1873, I have the honor respectfully to request that, for and ou Bacon, ot the comity ot iVIauison, Mississippi, yon shall appropriate out ot the County Treasury of the said county of Madison, the sum of (S.TO,-0XI).ono hundred and fifty tliousanddollars, which shall be and constitute a donation by said county ot Madison to the Yazoo City aud azoo val ley liailroad Couipanv, to aid in tho construction, maintenance and op era! ion of a railroad from Canton, Madison county, Mississippi, to Yazoo City, Yazoo county, Mississippi ; and that, in order to obtain the requisite authority to make said appropriation, your honorable body shall at once submit Ihe question ot Donation or " o Donation, to the qualified voters rt said county ot Madison. Ami in compliance with Section (22) twentv-two of the aforenien tionei! Act ot Incorporation, I hereby submit the terms and conditions on which I request the said county ot Madison to grant such donation, to-wit 1st. Should the result of the said election at which is submitted to the qualified voters of said county of Madison the question of " Dona tion '' or " Xo Donation," to aid iu the construction, maintenance and operation of the Yazoo City, Yazoo Valley Railroad Company, be in favor of said " Donation,' then the Hoard of Supervisors of said county shall order and cause to be issueil and delivered lo VALENTINE Wekner, his successors or assigns, a warrant or warrants of said county, on the County Treasury thereof, said warrants to be drawn in favor of Valentine Werner, his successors or assigns, and the same shall be transferable and shall bo due and payable on the first day of January, A. D. 1871, anil the said warrant or warrants shall be for the sum of (15,00(1) fifteen thousand dollars: Provided, That before the said Valentine Werner, his suc cessors or assigns, shall have the right or authority to demand or re ceive a warrant for said sum, or any park thereof, he or they shall satisfy the Board of Supervisors of said county of Madison, that they have fully graded and laid the cross ties upon (10) ten miles of saidrailroad, in tne located line luereot, netween tne city ot Uantoii and lazooUity. Ami whenever the said Valentine Werner, his successors and as- sicrns. shall satisfy the Board of Suoervisois of the. said coimtv of M;i1- isoli, that he or they have graded and placed the necessary cross-ties up- StOYCS, iwcui -u iiii:i m oi sain iaiiroau on mo located line tuereor, oetween Canton and Yazoo City, and shall have constructed a permanent railroad Stone over the LHg lllack river, then the said Valentine W erntr, his sue cessors or assigns, shall be entitled to demand and shall receive the war rants of the said couuty of Madison, drawn ou tho Treasury of said county for the further sum of (00,000) sixty thousand doll us, which said warrants shall be in all respects like the first, except that they shall be payable in equal and animal sums of (815,000) fifteen thousand dollars, to-wit: One installment of (615,000) fifteen thousand dollars being due aud payable on the first day of January, 1875; a like installment due and payable on the first day of January, 1870 ; i like installment due aud payable on the first day of January, 1877 ; and a like installment of said warrants due and payable on the hrst day of January, 1S7S. 3d. Ordered by the Board, that said application be received and spread upon the iniuutes, aud ordered to be published in the American Citizeu and Canton Jlail, weekly newspapers, published iu the town of Canton, for the period ot lour weeks consecutively; And it is hereby further Ordered, That the terms and conditions set forth iu said application be anil they are hereby agreed to by and between saiil Werner and this ISoard; And further, That the proposition of said Werner, as set forth in said application, be submitted to the qualified voters of Madison County, in manner and lonn, and in ctlcet, and at tlie tune tollowing, to wit: Valantine Wkbnek, ou behalf of himself, having applied for an order to submit to the qualified voters of Madisou county, Mississippi, the question of "Donation" or "Xo Donation," to aid in tlie construction, maintenance and operation of the Yazoo City, Yazoo Valley Kailroad, aud specified the amount of such donation to be the sum of (150,000) one hundred and tilty thousand dollars; and this ISoard having considered ot the same hereby agrees with the said Werner, to submit the question iu ciaiiuci iifld form as by Iiim requested. It is further agreed by and be tween the s:iid Werner and this Hoard, that if this Hoard shall by the I votes of said qualified voters of said Madison county, at such election be authorized to make said donation to the amount agreed upon, then this Hoard shall make the appropriation therefor, in the manner and on the conditions specified in his (Werner's) said application, and as requested by said Werner, and agreed to by this Hoard, and none other; therefore Ordered by the Board, That an election be held at the several voting precincts of Madison county, ou the twelfth day of Apiil next, at which election the question of"Donation'' or "Xo Donation," to aid in construction, maintenance and operation of the Ya.oo City, Yazoo Valley Uailroad, to tin; amount of (150,000) one hundred and litlv thousand dollars, shall be submitted to the qualified voteis of said county, for their assent or dissent thereto, on the terms and conditions iu the application of said Werner set forth, and herein before agreed to. i It is further Ordered, That the ISoard of Registrars ot Madison coiin-!ty be notified by the Clerk of this Hoard, by delivering to the President of said ISoard a certified copy ol this proceeding, to order said election, and to attend, supervise ami conduct the same in all things according to law.
