Nichols Joined tbe same company at the same time 1 waa with tbe company most of tbe time until tbe surrender. I never knew any punishment inflicted upon bim and I never heard of John T. Nicbola wearing a barrel ahirt until Mr. ack Dickey came to see me yes terday and said so, and I would swear to the best of my belief that he waa captured at Spotsylvania, Va. P.

Dickey publishes in bis letter, but I did say in talking about fighting, that we would all run at times. 1 was not with the mpany after December, 1862, and know nothing of what occurred after then. Nichols was a good soldier while I was with tbe company as any man that belonged to the compinr. A. Evans.

Ths battle, according to my recollection, was fought on September 17th, 1862 I further certify that iu going into the battle I saw John T. Nichols, then orderly Sergeant of Company D. 3d Regiment N. Troops deser the Company and ruu away that be came back to his company iu about four week that for hi desertion he was court martialed and to be reduced to ranks and wear a barrel shirt for cowardice. The balance of the certificate is incorrect the "charge." I was io command of the company to which you belonged and waa member of the court that tried tbe caae The court waa held about tbe fint of November, 18C3. The charge wat being abtent without leave and conduct unbecoming a non eotnmiakioned officer, and the olfenoa oonaiated in going to the hot- plUI without a written permit from the aurgeoo of the regiment. There bad been a disturbance about vou reading Kolden'i paper a few days before. You say it waa reported that tbe charge waa cowardice. It was nat, it was a regimental court, the moat Inferior court known to the miy, which could oolv try ietty cases and nutters of discipline in the regiment.

Crimes of a more aeiious character, snch aa desertion, w-ardice and the like had to be tritd by a general court martialed. There bad been nothing brought against you up to this date. Thia is to certily I know John T. Nichols, of Oak Grove township Dur ham county, have known him from boyhood. We joined the army of tbe Confederate State together in Company, D. 30th Regiment N. C.

Va in September (I think it was), John T- Nichola went to the hospital without proper authority and ws reported by me (then cting as Orderly Sergei t) absent without leave. Said Nichola came hack to the company about tho last of October, with a proper die charge from tbe hospital, and about the 1st of November, 1863, he was court-martialed for absence without leave and reduced to rank. No other punishment waa iuflicted. Tbe talement of Mr. Dickey' card, published in the the Daily Plant of Au gust 21, 188S, incorrect: I said, "if I knew anything against Nichols I would not tell it unles forced lo do so." The aboTcl is only thirty ever brought againat Nichols during tbe war.
