Main Clawson. Memorials to Hospice of Southeastern Mich. BY CECIL ANGEL Free Press Staff Writer The defense attorney for Cassandra Rutherford told Recorder's Court jury members Tuesday that they won't fcee his client in the amateur videotape jjf two suburban women being beaten end kicked during a downtown Detroit fireworks celebration. "You won't see her at all," said Cornelius Pitts in his opening statement in the second of three trials for Rutherford. I Rutherford, 17, of Detroit is jcharged with beating Joanne Was, 43, trf Farmington Hills on June 28, causing 'great bodily harm less than murder.

Last week, Rutherford was acquitted of unarmed robbery. She was accused of helping to snatch a gold chain from Lisa Rusin of Royal Oak. Immediately following this trial, she will be tried in the alleged theft of jewelry from a Dearborn woman. 'i Four other defendants pleaded no fcontest to assorted charges stemming from an attack on Was, her two daughters and two family friends. I Pitts said his client was present but did not take part in the beating.

Several people involved in the incident later aid the Was group provoked the attack with racial slurs. I Assistant Wayne County Prosecutor Lisa Lindsey told jurors that Rutherford's statement to police after the Incident doesn't mention those racial slurs. Battle over cameras I The Free Press will be back in court this morning to renew its legal battle to have a newspaper photographer in the courtroom during Cassandra Rutherford's trial. Memorials may be made to the Alzhelmers ruling from the Michigan Court of Appeals, which ordered Recorder's Court Judge Vera Massey-Jones to grant the newspaper a hearing and said there appeared to be no legal reason to exclude its photographer. The judge had earlier granted permission for a television camera in the courtroom. Massey-Jones held the hearing and agreed to let a Free Press photographer into the courtroom.

But a few hours later, she said the camera shutter was making too much noise and called for another hearing on the matter. The camera used Tuesday by photographer William Archie was the same type routinely used by Free Press photographers in courtrooms. State law allows a judge to bar cameras from the courtroom if they would interfere with the administration of justice. Free Press attorney Herschel Fink said he and a photographer will go to court today with a camera that has a very quiet shutter designed for bird watchers. Association.
