Given their predicament 14'6 games out of first place and Jjehind the Tigers in the East it was easy just to sit back and enjoy Avery, once one of the most dominant left-handers. He flirted with a no-hitter for five innings, winning his second straight start After a three-year slump in Atlanta and a two-month stint on the disabled list this season, Avery appears to have straightened himself out perhaps too late for the Red Sox, but not soon enough for him. "I'm much more aggressive," said Avery, 3-1 with a 2.33 ERA in four starts since coming off the DL.

"The only thing I'm worried about is taking the ball and throwing it as hard as I can. I'm not worried about making it sink or anything. I'm just throwing it" Avery (4-2), who hasn't pitched a complete game since May 1996 with Atlanta, didn't allow a hit until Julio Franco's clean single to center leading off the sixth. He allowed one run and four hits in Tk innings. Omar Vizquel, who had two of Cleveland's four hits, wasn't impressed with Avery rumored to be headed to the Indians and several other clubs.

"He didn't have much," Vizquel said. "Fastball, change-up, a little cutter. The ball was right there all the time. We didn't see the ball, I guess." Heathcliff Slocutnb pitched the ninth for his 15th save. Jose Mesa relieved Jaret Wright in the seventh and gave up an RBI single to Reggie Jefferson to make it 3-1.

After John Valentin doubled off the wall in left-center, Mesa intentionally walked Mo Vaughn. Jefferson lined a shot off the leftfield wall to score Valentin, but David Justice threw him out trying to stretch it to a double. New York 7, Milwaukee 3: Andy Pettitte (12-5) won his fourth straight for the visiting Yankees. Pettitte picked off Jack Voigt at first to end the third and trapped Kelly Stinnett in the seventh. The left-hander leads the league with 11 pickoffs.

Baltimore 5, Texas 1: Rafael Palmeiro hit a two-run homer, and Jimmy Key (13-6) allowed six hits and struck out seven in six innings for the visiting Orioles. NL Rodriguez's slam wins for Expos Montreal 8, Colorado 4: Menry Rodriguez broke out of a 7-for-76 slump with a two-out, ninth-inning grand slam as the host Expos rallied to snap a three-game losing streak. Atlanta 5, Los Angeles 4 (10 innings): Jeff Blauser's single finished the Braves' longest home stand at 6-6. Fred McGriff went 3-for-4 and hit his second homer in four days, a 424-foot drive off Scott Radinsky to put the Braves ahead, 4-3, in the seventh. The next inning, Eric Karros hit his 23rd homer to tie it.

San Diego 10, Florida 2: Wally Joyner went 3-for-4 with two walks for the visiting Padres. Outfielder John Cangelosi became the first position player to pitch for the Marlins, giving up a walk in a scoreless ninth inning. Cangelosi pitched two scoreless innings for Pittsburgh in 1988, one scoreless inning for Houston in 1995. Pittsburgh 3r Philadelphia 2: Curt Schilling struck out 15, most in the NL this season, but lost on home runs by Al Martin and Kevin Polcovich for the visiting Pirates. New York 5, Cincinnati 3: Carl Everett homered twice against Cincinnati as the host Mets swept four.

St Louis 7, San Francisco 2: Gary Gaetti had a home run, two doubles and three RBIs, and Matt Morris (7-6) allowed a run and five hits in seven innings for the host Cardinals. 320. 20340. Braves 5, Dodgers 4 (10) (Home teams In CAPITALS) nl Standings ATLANTA LOS ANGELES abrhb) abrhbl By Gene guidi Free Press Sports Writer The Tigers cleared a roster spot Monday for the return of left-hander Justin Thompson by releasing right-hander Jose Bautista. "We talked a lot about what we should do," manager Buddy Bell said. "The logical move seemed to be letting Bautista go." The recent trip sealed Bautista's fate.

He pitched one inning in three games, giving up seven runs. As he emptied his locker Monday, Bautista said he was Tiappy to be getting out of here." "I was never really happy here," Bautista said. "Not with the way they used me, pitching me in 10-1 and 10-2 games. I don't say anything because I'm a real professional, but I didn't like that. "I would sit in the bullpen for seven days 10 days before they bring me in.

How you supposed to do anything good when that's the way you're used? You saw what I could do before the All-Star break when I got in a few games I pitched good." Bautista, who turns 33 Saturday, signed in the offseason as a free agent. He was 2-2 with a 6.69 ERA in 22 games. Batters hit .324 against him. "I know that if I get the chance, I can still pitch," Bautista said. "I can still throw 90 miles per hour.

"What happened here is that I got with a team that was building for the future, which is not good for someone like me. It's better that I get released than sticking around in a situation like this." NO MINOR ACHIEVEMENT: Juan Encarnacion, a right-fielder at Double-A Jacksonville, went 4-for-4 with three home runs and six RBIs as the Southern League All-Stars beat the Seattle Mariners, 9-3, at Zebulon, N.C. 21, is hitting .348 with 22 homers and 67 RBIs for the Suns. He hit a solo homer in the first inning, two-run homers in the third and seventh, and an RBI single in the eighth. Beginning a five-city, 12-game trip, Mariners manager Lou Piniella pulled his starters after one inning.

BlG FOUR: The Tigers will use a four-man rotation for the rest of the month because of days off Thursday and next Monday. Thompson, Willie Blair, Scott Sanders and Brian Moehler will start, with Glen Dishman in the bullpen until he's needed as a starter in early August MOVING UP: Bobby Higginson is hitting .345 (19-for-55) in his past 16 games to raise his average to .274. It gives the outfielder hope for his second .300 season; he hit .320 last year. "I don't think .300 is out of reach, even though I know it won't be easy," Higginson said. "I got my average up to .280 in New York at the start of this last road trip, but slipped back again." Higginson said inconsistency has been his biggest problem.

"I have my stroke one day and the next day I don't," Higginson said. The one thing I feel good about is that my RBI production is up even though 1 gave away some opportunities early in the season." Higginson has 23 RBIs in his past 20 games; overall, he has 58 in 84 games. He had 81 RBIs in 130 games last season. NOTEBOOK: Moehler will make his team-leading 20th start tonight Shortstop Orlando Miller got his second start of the season at designated hitter. 4110 5120 4113 Cedeno cf Guerrero is Mondesi rf Karros lb ZeHe3b 3 11 4000 300 0 5022 5121 5 000 4131 0000 502 1 3 000 3110 0000 5 220 2010 Blauser ss Tucker rf Jones 3b McGriff lb BoutWa 8 Klesko AJonos cf Perez Boiard pr Lemke 2b Gtsvine Ashley HoasndswrthKIOlO Prince 1000 3000 4000 2 000 1000 00 00 0000 1000 00 00 0000 Locknart ph Lkiano 2b Homo Butler Ph Radinsky Hat Anthony ph Guthrie Dreifort Gnssom.

Pittsburgh Loelza (W 7-7) Ruebel Wlklns Lohele (S 14) a flight from Milwaukee to New York after Monday's game. Whiten was not going to travel with the team. The district attorney's office will review the case today and decide whether to file a charge, Meress said.

Whiten was to meet with the district attorney, Glynn said. Police officers were called about 4 a.m. Saturday to a downtown location in the same block as the Pfister Hotel where the Yankees stay, Sgt Earnell Lucas said. Officers conducted an investigation but "at that time there was no allegation of sexual assault," Lucas said. "We developed information that some incident did occur.

It wasn't until this morning when we re-interviewed the alleged victim that we developed enough information to pursue a possible charge of sexual assault," he said. "He (Whiten) was contacted and he voluntarily came to Milwaukee police headquarters today. Shortly thereafter, he was placed under arrest," Lucas said. The club wouldn't discuss specifics involving Whiten, whose wife delivered the couple's second child last week. Whiten, signed as a free agent Jan.

9, has played for seven other teams since his debut with Toronto in 1990. AWARDS: Oakland outfielder Matt Stairs, who hit .611 with five homers and 11 RBIs, is player of the week in the American League. Houston right-hander Darryl Kile, 2-0 with a four-hit shutout, is National League player of the week. ft BASEBALL: Paul Beeston's appointment as chief operating officer, scheduled to be announced today, might lead to Bud Selig becoming permanent commissioner. Beeston, president of the Blue Jays, will run the commissioner's office on a daily basis while Selig continues to operate out of his Milwaukee office.

Baseball has been without an on-site chief since April 1993, when deputy commissioner Steve Greenberg left seven months after Fay Vincent's forced resignation as commissioner. Selig, president of the Brewers, has run baseball since September 1992 as chief of the owners' 10-man executive council, BOSTON: Mo Vaughn will not be charged with assault until a man who says the first baseman hit him in the mouth can present more evidence that his story is true. 'We're not doing anything at the moment," chief prosecutor Carolyn Allen said. Scott Bird, 24, of North Olmsted, Ohio, must show more witnesses and medical documentation before her office will press a misdemeanor assault charge, Allen said. "I wasn't at fault with what happened," Vaughn said.

"I'm glad to get past that and get over with it." Bird said his teeth were loosened and his lip cut during a scuffle in the doorway of a nude dance club early Saturday. Bird filed a police complaint saying Vaughn hit him. PHILADELPHIA: Outfielder Darren Daulton, 35, was traded to Florida for outfielder Billy McMillon. Daulton, who has had nine knee operations. Is hitting .264 with 11 home runs and 42 RBIs.

McMillon, 25, hit .299 in five minor league seasons.
