Interment Resurrection. 4, 1997. Beloved husband of Mar- curity classifications, access to the courts, use of telephones and the use of typewriters and computers. A group of female prisoners joined the case, which now is a class action. The Legislature passed a law in 1989 to limit inmates' possessions, much like the department policy would, and Giddings blocked that, too.

Giddings has issued dozens of preliminary orders in the case, and held many hearings on such issues as prisoner possession of metal and glass objects, whether witness fees would be paid, and the availability of televisions and common merchandise catalogs. he orders issued by Judge Giddings in this lawsuit have affected the day-to-day operations of virtually every prison in the state of Michigan, from minimum security camps to the Ionia Maximum Security Facility," the Department of Corrections has said. The challenged policy would cut in half the amount of possessions allowed each prisoner, eliminating certain items that could be fashioned into weapons or like hooded sweatshirts used to conceal identity. "Our basic position is we have the right to decide what prisoners can have and how much they can have," said Mariorie Van Ochten, administrator of the office of policy and hearings for the Department of Corrections. But Sandra Girard, an attorney for Prison Legal Services of Michigan who represents the male inmates, said the state wants to take possessions without reimbursement or make prisoners pay to send them home.

By Malcolm Johnson Associated Press LANSING Since 1988, a hotly contested lawsuit has pitted prison inmates against the state Department of Corrections and Gov. John Engler against an Ingham County circuit judge. This week, Circuit Judge James Giddings finally is to begin the trial of the suit. Prisoners are challenging the department's power to control tjieir possessions. The trial could have at least 200 witnesses, mostly prisoners.

Attorneys for prisoners submitted a list of 700 potential witnesses. Giddings has estimated that the trial, to begin Thursday, could last as long as six weeks. The case has been overshadowed by insults, political posturing and attempts to remove Giddings. Engler ionce called him a "lunatic" and suggested he got his law degree through mail. The state Supreme Court Refused to disqualify Giddings from the case.

"A lot of this case is symbolism, but it deals with society's expectation hat people in prison should fall un-ider tight restrictions and not have ability to demand nine years in leourt time," said state Sen. William Regenmorter, R-Hudsonville, chairman of the Senate Judiciary Committee. The Cain case named after John Cain, a plaintiff who's serving 45 to 100 years in prison for a 1985 Ishooting attempts to prevent the Istate from restricting prisoner property, especially in the most secure prisons. Giddings blocked the policy, pending the trial. Prisoners later expanded the complaint to include se KELSO Loving tamer ot uonno Ralph) Pakizer, Robert (Susan), James (Lois), Patricia (Larry) McAnally, -and Paul (Shirley).
