Brennan, for a law school in Lansing. Brennan, who already has written members of the state board expressing outrage that they have not acted to give his school a charter, proposed last year that he be allowed to establish a private law school in the basement of a Lansing parochial school building.

The school would be known as the Thomas Cooley Law School after an early Michigan Supreme Court justice. THE 10-MEMBER law committee named by the state board to review Brennan' proposal said more than a month ago that the proposed school fails "to comply with minimum financial needs for any sound educational enterprise" and does not fulfill the state requirements for a private school. Michigan law requires that a educational corporation such as Brennan proposes have an operating capital of $1 million, of which "at least 50 percent has been paid in or reduced to possession." Justice Brennan has listed as the school's financial resources its anticipated incom from $1,500 student tuition and a $15,000 letter of credit from the Michigan National Bank. Brennan said. In meetings with the state board and the committee of lawyers, that his resources are adequate.

The state board has said In previous cases that anticipated tuition can be used "as all or part" of the capital funds required under the law. Assistant Attorney General Eugene Krasicky has told the state board informally that Brennan Is correct and that its long-standing policy is leSiti-mate. But the law committee says the state board policy is in violation of the law and spends five pages of its report arguing that point. The board will consider whether to grant Brennan's school a charter at its June 14 meeting. Also pending are requests by Michigan State Uni-versitv and Grand Valley State "College that they be allowed to start publicly funded law schools.
