"We'd be breaking the law, the Ontario Human Rights Code, by not selling to United States citizens," Baker said. Demand has been exceeding supply at Video Gallery. Would-be purchasers were plunking down deposits Thursday on boxes that will not be available until June 20 but no one seemed to be complaining. Baker and Krzeminski, both Canadian, sell the boxes for $199 in Canadian currency or $169 in U.S. currency.

They also accept credit cards. During a half-hour Thursday, about 20 customers placed orders. Nearly all paid the deposit in American cash. ON TV sells its decoder service to 65,000 subscribers for $22.50 a month plus an installation fee of $49.95 and a refundable deposit of $50. VIDEO GALLERY has been in business about a year, the owners said.

Almost the entire business is devoted to the ON TV decoders, although it also sells more complex devices that unscramble the television signal of Home Box Office, which is primarily available to cable subscribers. The HBO setup requires the installation of a microwave dish, about 30 inches in diameter, sold as part of the package, on the customer's roof. The ON TV decoder box, about eight inches square and four inches high, may be installed in about 30 minutes with ordinary, tools, Video Gallery's customers are told. Baker and Krzeminski refused to say how many boxes they have sold. KERICH, OF TROY-BASED ON TV, referred to Video Gallery's owners Thursday as "thieves" and "shoplifters." "The tendency of some people is to treat thieves like they're Robin Hood.

This is not a case of the little guys vs. the big guys. This is outright thievery. A $120.00 value and on tne run. I ney re trying 10 get na 01 this stuff quick and are probably doing it at night." KATALENICH SAID whoever the culprits are, the reasons seem pretty clear money. "They want to avoid the cost of disposing of the chemical properly," he said, adding that it costs $30 to $40 per drum to dispose of chemical waste in the way the law prescribes. The most likely suspect, according to Katalenich, is some kind of paint manufacturer, supplier or buyer. Two men were questioned and released after they were seen driving a truck near one of the Detroit sites Tuesday.

"We've got witnesses who saw the dumping itself, but no one who can identify the people doing the dumping. It was dark and at a distance," Katalenich said. Katalenich hesitiated to speculate about what the substances are but agreed they could be varnish. "If you just look at it, you want to say varnish. It appears to be varnish but we can't say exactly.

It's probably some kind of waste or paint material that got outdated," he said. SOME OF THE DRUMS found Tuesday, Wednesday and Thursday may have been dumped as long ago as last Friday, Katalenich said. The most puzzling thing, he said, is that so many drums He been found inside the Detroit city limits. "My experience is that when these people want to do this, they do it in rural areas to keep down the chances of being caught," Katalenich said. "I can't explain why it's happening at so many locations in the city." in? international boundary knowingly engaged in an activity they recognize is illegal," Kerich said.

"ON Television employs a hell of a lot of people in Detroit and provides a livelihood for a lot of others. If they (Video Gallery) were wildly successful and, as a result, made us unsuccessful, if we weren't in business, what good would be the boxes they're selling? OWNED AND OPERATED BY THE JOHNSTON MURPHY SHOE COMPANY. Not all styles in all sizes. Phone orders accepted. 1200 Pairs while supply lasts.

Offer limited to the first 950 customers. "What they are are shoplifters. If they were shoplifters down town they'd be put in the slammer. People don't think shoplifters are Robin Hoods. When are they going to wise up?" Kerich expects the U.S.

However, Kerich said, "that's not cast in concrete." In Chicago, regional customs counsel Saul Perla declined to comment until he has read DeMascio's order. "Because we haven't seen any order in that litigation, it's very difficult to make any comment. You're in an area right now where there's a great deal of controversy," Perla said.
