The Ziegfeld is my favorite Manhattan theatre. I may be 1 prejudiced because it is the one New York playhouse in which tile long-legged customer is not a forgotten man. Even a basketball center could be comfortable in those Ziegfeld seats. The Great Ziegfeld occupied this handsome theatre only five years. It opened Feb.

2, 1927, with "Rio Rita," starring Ethelind Terry. Last I heard of Ethelind she was working in a war plant coast. The second piece Kiegfeld was "Show Boat" with a cast including Norma Terrls, Dennis King, Helen Morgan, Jules Bledsoe, Charlie Winninger, and Edna May Oliver. Let's split open another paragraph. ZIEGFELD COJfTINTTED The third was on at th the third show at the Ziegfeld "Show Girl." And who played true, even if the man breaks the engagement.

At least it is in New Jersey. In the second district court of that state it was ruled an engagement ring is "a symbol or pledge" of the coming marriage and signifies the one who wears it i3 engaged to marry the man who gave it to her. If the engagement is broken the ring must be returned, as it is "a conditional gift." And the court further stated it makes no difference who breaks the engagement; the man gets back the ring. PASSING BY Joe Madden. Genial Manhattan steak house proprietor.

Joe says business is not so good in his line right now, but he has seen it a lot worse. As for example, one day during the depression in the early 1930's he opened his place at 12 noon and stayed open until midnight. His total receipts for the day were 50 cents! That reminds me a veteran taxi skipper recently told me that one day during the same depression he had his cab out eight hours one day and picked up only one passenger, who took a 35- cent ride. At last I had found a man who could lean down to kiss me. The other day I received a letter was in love girl. OTHMAN WASHINGTON, May SO. (U.PJ-- James Boyle a fat young man from Brooklyn, with a black, toothbrush mustache, an excitable manner, and a cigar that erupts sparks. He doesn't look like a gangster. He isn't a gangster. Anybody who says so is a no-good bum.

And if he goes calling with a friend who totes a pearl-handled revolver, the latter refrains from brandishing it under the noses of the guests at New York's Hampshire house on Central park. This information is official. It is sworn testimony by Gentleman Jim himself, who hurried here to deny before the torial small business committee that he'd ever tried to buy gray market steel at pistol-point. His testintany left the senators goggle-eyed. Talk abont a man with troubles and you're talking about Gentleman Jim, the proprietor of the United Nations Trading of Brooklyn's Montague street.

last week a Pittsburgh steel broker, E. A. Kerschbaumer, testified under oath that Boyle and two pistol-packing pals burst into his suite at the Hampshire house, unleashed their artillery, and said give 'em steel--or else. Kerschbaumer swore that Boyle was a Jersey mobster and that his pals were gangsters. He said that a Chicago steel broker, Ij.

C. Durham, fortunately was husky enough to disarm them. So all right. That same night--I mean the night of Kerschlraum's testimony here--Boyle was attending a society soiree in Brooklyn. Everybody was eating chicken served in ruffled paper pants.

Somebody rushed in with a newspaper. "You can imagine my embarrassment," Boyle testified. "With several hundred people there, and I knew them well, all looking at this newspaper." He said he meant the New York World-Telegram. It contained a dispatch by a fellow down in Washington, name of a describing Kersch tiaum's emotions when con fronted by nickle-plated shooting MorreH's, Peyton's String End Ag Butt End AC Tenderized HamsfO dZ EASTERN Sliced Bacon ARMOURS Star Shortening 29 BONELESS Corned Beef 39 TALL CAN Carnation JfO. 2 CUT Green Beans each I44 GRADE A EASTERN Sirloin Si i COLORADO GOLD Butler 55 BABY BEEF Liver NO.

It was a good story Boyle testified, bnt It quoted a bum, who also was no good, and--he said--prohably psychopathic. Gentleman Jim ran outside and got in his car and there was the radio, blaring about his being a gangster. 'And then the phone calls," be moaned. "I must hare got 500 of 'em. I was thinking about having the phone ripped out and that wasn't all." The United Nations--the one that runs the world--was worried abont Boyle's United Na.

tions Co. and announced there no connection between the two. That brought on more phone calls and Boyle said he got on the phone himself, and talked to this Othman in Washington. "He said.lt wag true and that's Friday May as. 1MT why I asked to testify," Gentleman 31m added.

He said he'd ordered Rome steel from Kerschbaum, all right, and he dropped by the Hampshire house with the Messrs. Robert Wyder and Paul Sponberg to see why it hadn't been delivered. Nobody polled any guns. did anybody hare a gun?" Insisted Committee Counsel Ray Diekey. Well, said Boyle, Wyder did have a small one in his pocket, but he didn't wave it under anybody's nose.

It Durham hadn't searched him, nobody would have known. Subsequent testimony by Durham indicated that the shootin Iron was a .82 calibre, pearl- handled Colt revolver. And I hope this takes care of the confusion that grew in Brooklyn. My good friend Othman is all caught up with being a subject of his own news dispatches. Makes 'em too hard to write.
