Herb McCord, president of CKLW radio, tayi that his attorney! are preparing a million-dollkr-plus restraint-of-trade suit against the Arbitron Radio Ratings Service as a result of Arbitron's plan to reclassify CKLW In Its next ratings book as NOT being a member of the, metropolitan Detroit radio market. The listing in question is Arbitron's rundown of radio stations and their audience sizes, published periodically for every radio market in the U.S. Stations on the fringe of those markets normally are listed separately. Since CKLW is in Windsor and not Detroit, reasons Arbitron, that is the treatment it should get. It is, however, not the treatment CKLW has been getting for years, and that is what has McCord so ready to fight.

While Arbitron is often referred to as the "bible of broadcasting," it is more than that. It's the Bible, Torah and Bhagavad-Gita rolled into one. It's the only game that counts when advertising agencies and their clients are deciding where to spend their money, especially national advertisers who can account for as much as 50 percent of a station's revenue when you're talking about a station with the reach of CKLW. And if an advertiser doesn't find CK at the top of the list of the metropolitan Detroit radio market, then CK may not get that business. Because of this relationship between the Arbitron ratings and advertising revenue, McCord said, the reclassification "could cost us millions.

What I'm saying is that I hope the local agencies (advertisers) know us well enough so that where we're positioned in the book won't hurt us. But nationally it could be disastrous, especially for those accounts that make one buy only in Detroit. We've been at the top of the listings for years and years, and if this goes through, now we'll be way below the line where the potential buyer may never get to us when going down the list. "We would hope legal action won't be necessary. But we have one more meeting with Arbitron, and I really feel like we're going to have to go into court based on what's come out of our previous talks." Ed Christian, chief of radio stations WKNRWNIC-FM and Detroit representative to the Arbitron Advisory Board, said Wednesday from New York, where he was visiting Arbitron, that, contrary to local reports, he was not responsible for leading the drive to have CK repositioned.

He said Arbitron had been considering CK's status in Detroit for some time, along with the status of Mexican stations in the San Diego and El Paso markets. 1 "There are three markets in the country where this is applicable, in that a foreign station broadcasts primarily into a U.S. market. A similar situation arose recently in San Diego, and one of the stations wrote to me about their feelings. I passed that letter without comment on to Arbitron because of discussions the advisory board had previously about CK, a Canadian station, not technically being in Detroit, and Arbitron then made its own decision.

"Sure it's going to hurt them (CKLW) in terms of national buys, moving from the very top of the list to below the line. There's a psychological edge to that position if nothing else."
