Ernest Morris said charges that the horse was tampered with were "irresponsible." He said Niatross was given a blood test before and after the race, and that both tests were negative. The Staff's motion asks that the issue of the proper reconciliation period for future rec-'onciliations be set for hearing in a proceeding separate from the refund order. The Michigan Public Service Commission has scheduled hearings on the Application and has ordered that NOTICE BE GIVEN that: A.

The initial hearing in this matter will be held at 1:30 PM on July 22, 1980 in the offices of the Commission, Mercantile Building, 6545 Mercantile Way, Lansing, Michigan 48909, which hearing will be in the nature of a prehearing conference and will be held for the purpose of setting a schedule of hearings and exploring and, if possible, agreeing upon matters which will expedite this proceeding. Any interested persons may attend the hearing and participate, subject to the provisions of the Commission's Rules of Practice and Procedure. B. Oral argument on the Staff's Motion for an Order Compelling Immediate Refund of Entire PGA Overrecovery will be held at a time set by the presiding administrative law judge. C.

Any person seeking to intervene, in accordance with Rule 11 of the Rules of Practice and Procedure Before the Commission, shall file with the Commission, on or before July 17, 1980, an original and 12 copies of a petition to intervene, together with proof of service upon the Managing Attorney Utility Regulatory Matters, Consumers Power Company, 212 West Michigan Avenue, Jackson, Michigan 49201. Jurisdiction is pursuant to 1909 PA 300, as amended, MCLA 462.2 et seq; 1919 PA 419, as amended, MCLA 460.51 et seq; 1939 PA 3, as amended, MCLA 460.1 et seq; 1969 PA 306, as amended, MCLA 24.201 et seq; and the Commission's Rules of Practice and Procedure, 1954 Administrative Code, 1968 Annual Supplement, 460.11 et seq. On April 30, 1980 Consumers Power Company filed an Application with the Michigan Public Service Commission in Case No. U-6492 requesting authority to modify its purchased gas adjustment clause so that the determination of whether the clause has resulted in an overrecovery or under-recovery of the Company's cost of gas will be made on the basis of a calendar year. Currently, that determination is made on the basis of a 12-month period ending March 31 of each year.

In its Application, the Company stated that the operation of its current purchasedgas adjustment clause is such that it will typically overrecover early in any given calendar year and underrecover during much of the remainder of the year. The operation of the current clause resulted in oyerrecoveries of approximately $11.2 million in the first three months of 1980. The Company anticipates that during the last three quarters of 1980 and the last three quarters of subsequent years, substantial underrecoveries will occur. Under the current procedures, an annual reconciliation of purchased gas adjustment clause revenues is made as of March 31. The Company calculates whether there has been a net overrecovery or underrecovery over the past 12 months and refunds the amount, if any, that has been over-recovered.

If during the remainder of the calendar year underrecoveries occur, they will be reflected in the Company's year-end financial results as lowered earnings, even though they will likely be offset by overrecovnries in the first quarter of the following year. In order to more accurately reflect its year-end financial condition, the Company proposes that the annual reconciliation be made at the end of calendar years. Because the first three months of 1979 have been included as part of a prior reconciliation period, the Company proposes that the first reconciliation period utilizing a December 31 end-of-period consist of the last nine months of 1979. During that period, an overrecovery of approximately $8.3 million occurred. The Company proposes to refund that amount through a uniform refund factor of $.0473 per thousand cubic feet during the July 1980 billing month.

The Staff of the Michigan Public Service Commission has filed a motion which proposes that the Company immediately refund approxi entries TH-Purse $1,250, cond. pace, mile: 1- Jeff Gold C. Putnam 2- Wln Red R. White 3- And Shadow T. Clark 4- Alleans Candvman F.
