3 EPA Tackles Iron-Waste Dumping DETROIT FREE PRESS Saturday, May 24, '75 5-A hi i'-T crowLers BY SAUL FRIEDMAN Fm Prtu Wihlmton stiff WASHINGTON After a delay in getting an Environmental Protection Agency vZPA) task force has begun its efforts to end the dumping of iron-mining wastes into Lake Supe-' rior. But the chairman of the task force, Robert Zeller, ordered members to conduct their work in secrecy amid indications that it may be as many as five years before the Reserve Mining Co. of Silver Bay, is required to dispose of its wastes on land. ASKED WHY the task force will meet in closed session, with members cautioned against talking with the press, Zeller said: "I don't feel I have to justify this. Summaries of the meetings could be available on request, although I don't think we're obligated to do that." The task force- was created by EPA chief Russell Train six weeks ago partly to mollify criticism aimed at Train by attorneys, lawmakers and citizens who have been active in the case against Reserve.

Train was under attack because the Justice Department, at his request, dropped further legal attempts to end the dumping quickly. A lower federal court had ruled that Reserve's disposal of 67,000 tons of wastes daily into the lake was a potentially serious health hazard because the asbestos fibers in the wastes are a cancer-causing agent Nevertheless, the refused to close the plant and gave Reserve a "reasonable" time to convert to on-land disposal because 3,000 jobs were at stake and no directly related cancer deaths have turned up yet. The government was in the process of appealing to the Supreme Court when Train put the legal brakes on. Following protests, Train announced the creation of a task force to help negotiate a settlement which would convert Reserve's process to on-land dumping within the "reasonable" time suggested by the court. A member of the task force told the Knight Newspapers "that it will be at least three years before Reserve goes on land, and I would not be surprised if it is as much as five years." "it.

6th Circuit Court of Appeals took no action Friday on a request by the state of Michigan for a delay in the federal court order requiring the state to acquire 150 buses for a Detroit school integration plan. A representative of Attorney General Frank J. Kelley filed the application for a delay of the bus-purchase order early Friday afternoon with the court clerk in Cincinnati. Court officials said the legal papers have been sent to the three judges of the appeals court who have been involved with the Detroit school case since 4970. They are Chief Judge Harry Phillips, who lives in Nashville, and Judges George C.
