Charged A DETROIT FREE PRESS Monday, May 27, 25, 1974 7B In Fatal Shooting Of Detroit Officer James Lee Springer, 45, was arraigned on a first-degree murder charge Sunday in the slaing of Police Officer Brendt L. Stephens, the fourth Detroit policeman to be killed this year. Police said the shooting grew out of a dispute between Springer's mother, Mrs. Hellewe Brack of 8584 Chrysler, and a next-door neighbor, Mrs. Dorothy Hudson.

THE TWO WOMEN had settled the dispute over Mrs. Brack's five dogs, police said, but Springer, of 2126 Chene, was not satisfied and went to Mrs. Hudson's home Saturday night. Noticing the outline of a revolver under Springer's jacket, Mrs. Hudson called police, who dispatched Stephens and his partner, Officer James Younger, to the scene as a backup unit.

But Stephens and Younger were the first to arrive. Seeing the unmarked scout car stopping in front of her home, Mrs. Hudson ran out her front door and Springer chased her with the gun, police said. But on noticing the police car, Springer ran into his mother's home with the policemen pursuing. He wheeled and fired, hitting Stephens in the chest, police said.

Younger helped Stephens back to the scout car and fired a shot when Springer appeared at the side of the house. The shot missed. After a second scout car arrived, Springer again appeared at the side of the house and Younger fired another shot, hitting Springer in the left ankle. He ran into his mother's home but surrendered a short time later. Stephens, 32, died a halfhour later at Henry Ford Hospital.

He had been a member of the 13th (Woodward) Precinct during his years on the force. He is survived by his wife, Tricia, and two children. At the arraignment, Sprinstood mute before Recorder's Court Judge Donald S. Leonard, who entered a plea of innocent for him. Springer was held without bond in the Wayne County Jail pending a pre-trial examination June 5.

The two were charged with trying to extort $1,500 for the chalices and communion trays stolen from the LaSallette Shrine in Ipswich, Mass. Chalices Recovered Nixon's 'Defiance' Boosts Chance of Ouster, Byrd Says WASHINGTON AP) President Nixon's "defiance up and down the line" over the Watergate issue has bolstered the prospect that the Senate would convict him in an impeachment trial, Sen. Robert C.

Byrd, D-W. said Sunday. Byrd, the assistant majority leader and a member of the Senate Judiciary Committee, said less than two months ago that such a vote if taken then would fail the needed two-thirds margin. But "I think the situation has hardened," since then, he said, although "no man living knows what the vote count will Ford Helps Defeat Arms Cuts WASHINGTON (UPI) An intensive personal lobbying campaign by Vice-President Gerald R. Ford and Defense Secretary James Schlesinger played key role in the stunning defeat of liberal attempts to cut the 1975 Pentagon budget on the House floor last week.

In addition, according to some congressional sources, the politics of impeachment may have helped to cement so me wavering Republican votes in favor of the $22.6 billion arms procurement measure. The liberal bloc, led by House Majority Leader Thomas P. O'Neill of Massachusetts and Rep. Les Aspin, a frequent critic of Pentagon waste, had spent weeks lining up a series of specific defense budget cuts. BUT WHEN the proposals reached the floor in a marathon session Wednesday, it became clear from the start that the Armed Services Committee chairman, F.

Edward Hebert, had marshaled a powerful conservative voting bloc. One by one the amendments went down to defeat: Rep. Robert L. Leggett, D- lost a proposal to cut Trident submarine construction from two a year to one, on a voice vote. bid Rep.

O'Neill's attempt to force a troop cut overseas was beaten, 240 to 163. Leggett's motion to reduce South Vietnam arms aid to $1 billion lost, 211 to 190.

Finally, Aspin and a group of both conservative and liberal backers were beaten 209 to 185 in a bid to cut $733 million from the overall budget. Byrd said the president treaded upon especially dangerous ground when he rejected the House impeachment panel's subpena for the tapes and documents "it needs to carry out its appropriate constitutional duties." "In so doing, I think it could be said the president is obstructing justice," said Byrd. Several members of the House panel have similarly indicated that they would look upon the withholding of evidence as a potentially impeachable offense. Byrd complained also of Nixon's failure to co-operate with Special Prosecutor Leon Jaworski's request for more tapes and to turn over materials subpenaed by the defendants in the plumbers trial. In the plumbers case, Judge Gerhard Gesell warned last week that he may dismiss all charges if the White House does not deliver documents wanted by former aides John D. Ehrlichman and Charles W.

Colson for their defense. They are accused of conspiring in the break-in at the office of Daniel Ellsberg's psychiatrist. IF NIXON does not make that evidence available, said Byrd, "it would amount to a form of executive clemency" for those two men. "It wouldn't be the court dropping the case, it would be the president." Byrd charged also that Nixon had violated his pledge not to attempt to limit Jaworski without first consulting the leaders of He referred to the disclosure early last week that the president's lawyer had argued as yet to no avail that Jaworski could not litigate against the president. The senator appeared on the CBS program "Face the Nation." THE PRESIDENT of the American Bar Association said Sunday that he was "shocked and annoyed" that Nixon has not publicly stated that he "is subject to the rule of law." Chesterfield H.

Smith suggested that the president tell the country: "I'm not a king. I'm a man elected by the people." Smith, interviewed on NBC's "Meet the Press," said he would prefer that Nixon find a way to "withdraw from public power" until Watergate related charges against him are disposed of. But, Smith said, he did not know of way the president could do this." Nixon's current refusal to subpenas does not, at present, mean he is placing himself above the law, Smith said. The president, Smith pointed out, has gone to court to contest the legality of the subpenas and does not have to comply with them while the appeal is in process. Smith said he did not think the president should be forced to give up tapes of conversations in which he speaks to his attorneys in a lawyer-client relationship.
