Call 404 222 8664 or write to columnist Doug Monroe at The Atlanta Journal Constitu tion PO Box 4689 Atlanta Ga 30302 ax: 404 526 5746 mail: trafficajccom Juries prefer alternative to death penalty By Mark Silk STA WRITER Twenty years after the US Supreme Court reinstat ed the death penalty a law allowing defendants to be sent to prison for life without parole appears to be sharply reducing the number of death sentences in Georgia Since July 1993 when the new law went into effect 35 sentences of life without parole have been imposed 18 by juries and 17 through negotiated pleas accord ing to the multi county public office But during that time only five defendants eligible for life without parole have been sentenced to death ourteen others sentenced to die were ineligible for life without parole because they committed their crimes prior to July 1993 Before the life without parole law took effect an av erage of 15 convicted murderers were sentenced to death every year was in favor of the law because I thought it would reduce the number of people on death said multi county public defender Mike Mears it looks like having that That was exactly what then Rep Tom Cauthorn feared when he spoke out against the life without pa role proposal before it was adopted during the 1993 leg islative session felt like in cases where death was appropriate the jury would not fulfill their responsibilities to their fellow Cauthorn said Under the law jurors in death penalty cases no longer have to choose between the electric chair and a simple life sentence which many Georgians believe can lead to an early parole Last week a Rockdale County jury declined to order the electrocution of Markus Crowder the ringleader of a crime gang who executed a grocery store after torturing him into revealing the combination to the store safe Two months ago co defen dant Marvin Turner also received life without parole still believe these two people deserved the ulti mate said Rockdale District Attorney Cheryl Custer life without parole is an easier emotional process for jurors to go through You do the right thing for society you do the right thing for the crime and you have to get into that moral issue of choos ing life or Although Americans by a wide margin say they sup port the death penalty they would prefer the option of life without parole accompanied by restitution accord ing to a 1993 poll conducted for the Washington based Death Penalty Information Center a lot of support in America for the death penalty but also a lot of support for the safety that life without parole said Robert Dieter the director Georgia prosecutors said they willingly negotiate pleas to life without parole in death penalty cases in or der to avoid lengthy appeals families general ly agree prosecutors say major consideration is the uncertainty of the death penalty versus the certainty of knowing he will spend the rest of his life behind said DeKalb County District Attorney Tom Morgan But Attorney General Mike Bowers doubted that life without parole would establish certainty will come a day most likely when there will' be a lot of litigation over life without Bowers said only sure thing is a death Triumph of the human spirit?
