And in the aftermath of ON-TV's decision Monday to cease operations in Detroit March 31, there is ample ugliness to spread around. Rumors of the demise of the pay-TV service, which has leased air time from Channel 20 (WXON-TV) since 1979, have turned to fact.

ON-TV program director John Tuohey said Tuesday more than 200 company employes will be out of a job at month's end. And about 42,000 subscribers will lose movies, sports and entertainment they were willing to pay $22.50 a month to see. And Wednesday, IT-TV, another pay TV service, had a press conference to let everyone know it was still functioning and would welcome old ON subscribers. Was ON-TV poorly managed? Or was it merely the victim of added competition from other pay-TV services and the growth of cable TV in the metropolitan area? Or, as some sources at ON-TV hint rather bitterly, was ON-TV pressured out of business by its air-time landlord, Channel 20? -t "IT WAS a very unsatisfactory 3 12-year relationship," said Bill Wischman, ON-TV assistant general manager. Said anON staffer who asked anonymity: "They (Channel 20) were really bent on harming the business in its present form." Doug Johnson, vice-president of WXON-TV and son of station owner Aben Johnson, denied that.

"We weren't pressuring them," he said. He maintained the only reason ON-TV is dead is because it offers only interim technology. "Cable is coming on so strong in this area," Johnson said, It's very competitive." But more to the point is the final resolution of a breach of contract suit filed by Channel 20 in U.S. District Court here against ON-TV and its parent company, Chartwell Communications of Los Angeles, in 1980. (ON-TV Detroit is one of several similarly named, scrambled signal, pay-TV services owned by different and successful companies in Chicago, Portland, Miami, Dallas and Cincinnati.) Initially, a jury found ON-TV had indeed breached its 50-year contract signed in 1976 and awarded WXON $16 million in damages.

But Judge Ralph Guy overturned the jury's decision last year. And in his final opinion on the case Feb. 15, Judge Guy further granted ON-TV's motions for a judgment notwithstanding the jury's verdict. So ON won but not really. THAT'S BECAUSE Judge Guy refused to grant ON-TV's countersuit claims for $28 million and for a new AnvrmisfMrNT ADULT THEATRES ACCORDING TO several sources, ON-TV paid the second highest lease rate in the country (behind Los Angeles).

ON paid Channel 20 $845 an hour, one source said, and was willing to triple that rate to $2,000 for the extra air time. But Channel 20 said no and continued to turn down ON-TV offers to purchase the station for as much as $20 million, three times its supposed market value.
