Apr 13 2005 PITTSBURGH POST-GAZETTE WEDNESDAY, APRIL 13, 2005 B-6 By Bill Toland Post-Gazette Harrisburg Bureau HARRISBURG A lobbying group representing school boards has filed a lawsuit seeking to delay the deadline for school districts to enroll in a property tax rollback program funded by gambling revenue. Districts must decide by May 30 whether to opt into the Act 72 property tax relief program, which Gov. Ed Rendell predicts will provide $1 billion in rollbacks to Pennsylvania homeowners. Before homeowners can see a check, their home school districts must first opt into Act 72. The Pennsylvania School Boards Association yesterday asked Commonwealth Court to delay the opt-in deadline a full year, until May 30, 2006, so school boards can have more time to gather information and decide.

Of the 501 school districts, only six have enrolled, including Beaver Midland district this week. think any district should have to make this decision right said Thomas Gentzel, director of the PSBA. because more to the decision than the anticipated property tax refunds. Districts must agree to a 0.1 percent earned income tax rate increase, and also must agree to allow vot- ers to decide, via referendum, whether property taxes can be increased beyond the rate of inflation, except in certain circumstances, laid out in the Act 72 law. Rendell, who campaigned on the property tax theme when he ran for governor in 2002, has been making stops across the state, saying the decision ought to be a no-brainer for schools.

The districts have had plenty of time, almost nine months, to review the law and decide whether a good deal. Gentzel and many local school officialsbelieve there are too many unanswered questions in the law. What about school districts whose geographical area covers parts of two counties, with two different real estate millage rates? If the proposed property tax increase exceeds the inflation rate in one part of the district, but not the other, would the whole school district get to vote on the increase? Or would just one part of the district vote? Also, the governor and the Legislature are still unclear how the pool of slots tax money will be distributed. None of it is spelled out in the law, Gentzel said, and just one of the problems. Act 72 was passed by the Legislature last July, along with the law that legalizes slot machine gambling in Pennsylvania.

That law, called Act 71, is currently being challenged in state Supreme Court, another reason school boards are tentative about the deal. A delay have any substantive impact on taxpayers, because most slots parlors be running by May 2006 anyway, meaning the state even have any slots revenue to distribute to homeowners by that point.
