again threw out the death sentence in one because the jury was not properly instructed during the penalty phase The court reissuing with minor revisions an opin ion released in January affirmed the conviction of Daryl Atkins for the August 1996 abduction rob bery and murder of Eric Nesbitt in York County but ordered a new sentencing hearing for Atkins The jury was not given a verdict form
