Jan 16 2009 Post-Gazette PITTSBURGH POST-GAZETTE SATURDAY, JANUARY 17, 2009 WWW.POST-GAZETTE.COM B-4 LOCAL NEWS EAST Church, Brookville extend homeless shelter agreement An agreement between a church that shelters homeless people and the borough of Brookville has been extended through March 20. First Apostles Church a federal lawsuit against the Jefferson County borough in November, saying the municipality had violated the rights by prohibiting it from allowing homeless people to stay in the parsonage. The suit was after Brookville cited the pastor for a zoning code violation, claiming that he was violating a rule that prohibited group housing. However, within days of action being taken in federal court, the two sides reached a temporary agreement that permitted the church to continue its homeless ministry while both sides negotiated how the church would be used. The original agreement allowed for as many as 10 people to stay in the three-bath parsonage.

The new agreement, yesterday in federal court, allows for as many as 30 people to stay in the facility, which is attached to the 111-year-old church. Excela Health to lay off 70 Greensburg-based Excela Health announced yesterday it will lay off 70 employees, part of an effort to cut costs as care expenses rise, the company said. The 70 cuts are to and staff and will represents less than 2 percent of 5,000 employees, spokeswoman Robin Jennings wrote in a statement. Total cost cutting measures, which include reducing some hours, holding or eliminating vacant positions, and reducing the use of temporary workers, will save the company $6 million in expenses, she said. hospital admissions, outpatient volumes and earnings from investments are down while uncompensated care expenses are Ms.

Jennings wrote. financial management in this unprecedented economic downturn is essential to long-term growth and Eligible employees will be offered severance based on their length of service. Parkway East lane to close tomorrow morning A single lane closure will occur on the inbound Parkway East (Interstate 376) east of the Penn Hills interchange (Exit 11) tomorrow morning for bridge inspection work, the Pennsylvania Department of Transportation announced. The closure will occur from 6 to 11 a.m. to allow consultant crews to continue inspection activities on the bridge that carries Jefferson Heights Road over the Parkway East.

It is a regularly scheduled routine inspection. Motorists were advised to use caution, slow down and be prepared for changing traffic patterns in the area. CITY Mayor resists return of suspended fireman Pittsburgh Mayor Luke Ravenstahl is resisting a decision by firefighters to return one of their colleagues to work despite a drug test failure. John Connors, 52, a firefighter since 1999, was subjected to drug tests following a 2007 arrest and subsequent guilty plea for drug possession. After he failed a drug test, according to documents obtained by the Post-Gazette, he was suspended from Nov.

7 through Dec. 13, pending termination. But the mayor fire a firefighter without a trial approval, according to a state law that governs personnel matters in Fire Bureau. The board consists of three firefighters. A trial board concluded on Dec.

8 that the city did not follow the letter of its contract when it conducted the drug test. Mr. Ravenstahl, though, disapproved of the findings on Tuesday, thrusting the matter into legal limbo. Another trial board may be convened. Trial boards are chosen through a process that gives the accused a lot of say.

First, the public safety director and the accused each choose the names of 25 firefighters of rank equal to, or higher than, the accused. The names are placed in a box, and seven are drawn. Each side can strike two, leaving three to decide the case. In Mr. case, the three awarded him back pay for nine missed days, plus holiday pay.

Neither the administration nor the firefighters union would comment this week. Mr. Connors declined to comment until he checked with union officials. City overseer owes former partner $717,000, court rules The head of one of state fiscal overseers must pay his former partner $717,000 as a result of a lawsuit related to their 2004 corporate divorce, the state Superior Court has ruled. Henry V.

Sciortino, of Philadelphia, is executive director of the Intergovernmental Cooperation Authority, which approves or rejects Pittsburgh budgets and can withhold some revenue. He was previously a partner of Rodney Johnson in two businesses, Fairmont Capital Advisors and Fairmont Asset Management. In 2006, a jury found and the Superior Court this week agreed that Mr. Sciortino shifted $244,000 from a joint account with Mr. Johnson into one he alone controlled; that he spent $248,000 in Fairmont funds on things including his home driveway and car lease payments; and that he interfered with Fairmont contracts to the tune of $225,000.

Mr. Sciortino could not be reached for comment yesterday. Though one of the contracts in dispute is Mr. pact with the ICA, the decision appear to alter his role with that agency. Reilly, Rudiak announce run for council seat Patrick Reilly, of Brookline, and Natalia Rudiak, of Carrick, have announced their intentions to run for the City Council seat now held by Jim Motznik.

Mr. Reilly, 26, is the community outreach coordinator for state Rep. Chelsa Wagner. Ms. Rudiak, 29, runs a small business helping nonprofit and community groups.

Both are Democrats. Mr. council term ends this year. He is expected to announce a bid for district judge today at 2 p.m. The primary is May 19.

Dowd curtails mailing A $3,000 mailing that Pittsburgh Councilman Patrick Dowd had planned to issue will now be curtailed amidst concerns that it may be viewed as a use of city funds to advance his possible mayoral bid, he said yesterday. would like to mail it out, but worried that if I do, I could be accused of using city money to promote my he said. Mr. Dowd said Monday that he might try to unseat Mayor Luke Ravenstahl. The four-page, color mailer includes the photo on the first, second and fourth pages.

It highlights instances in which he worked with Mr. Ravenstahl like their collaboration on bicycle-and-pedestrian improvements and times clashed. It notes that Mr. Dowd voted for campaign contribution limits that Mr. Ravenstahl vetoed, and that the councilman that the administration tear down burned-out Polish Hill buildings.

The report also advertises his in-district to meetings, and says he the effort to block a backroom deal for the largest without using tax dollars for his lawyers. Initial intentions to bulk mail it to every household in his district are canceled, said Mr. Dowd, replaced by a plan to print out 2,000 copies for around $300 in city money and maybe them in coffee shops, but still worried that be accused of mixing politics and Man found dead outside Mount Washington home Pittsburgh police are investigating the death of a 78-year-old man whose body was found outside a Mount Washington home yesterday. Foul play is not suspected in the death of Andrew Kostelnik, who lived in the 1000 block of Fritz Street, where his body was discovered just before 2 p.m., the Allegheny County medical office said. Mr.

Kostelnik was pronounced dead at the scene. A witness told police he saw Mr. Kostelnik about 11:30 a.m. Thursday across the street from his house and asked if he was OK. Mr.

NORTH Government seeks gag order in case of FBI death The federal government yesterday filed a motion objecting to the many news interviews given by attorneys who have represented Christina Korbe, the woman accused of killing FBI Special Agent Samuel Hicks. In a six-page motion, Assistant U.S.

Attorney Troy Rivetti said that both John Elash, who now represents Ms. Korbe, and Sumner Parker, her previous attorney, repeatedly made comments to the media that are likely to materially prejudice ongoing judicial Mr. Rivetti accused both men of talking about evidence that they should know would be inadmissible at trial, as well as discussions on Ms. character. Elash did with KDKA- TV on Thursday following his arraignment. In that interview, Mr. Elash referred to a number of recorded phone calls Ms. Korbe had with relatives from the county jail that were used against her during a detention hearing. Parking deal may advance North Hills school expansion The North Hills school board has reached an agreement to lease land from Christ Lutheran Church to provide additional parking at Highcliff Elementary School.

Renting property from the church for as long as the next 100 years would eliminate the need to get a steep- slope variance from the Ross zoning hearing board. District officials hope the move will put their plans to expand and renovate Highcliff back on track. Modernization of the school on Peony Avenue is part of a multiyear plan to replace seven existing elementary schools with four buildings of approximately equal size. Highcliff expansion plans still must be reviewed by the township planning commission and approved by commissioners before any work can begin. SOUTH California U.

of Pa. convocation center California University of Pennsylvania has won approval for a $54 million convocation center. The State System of Higher Education yesterday approved funding for the center, which has been part of the master plan since 1992.
