Charies Naylor themffered th resolution, which we give below, aad made a speech abounding ia valuable statistical delaite, which, we are sorry, that owin to the Uleaes! of the hour at wiiich the meeling ajjurued, prevents us from giving. He dwell upon the importance of tbe proposed Railroad to the prosperity of the United Slates, and the world in general, and declared that Pitis-bu gh, at lb. present lime, was tk most important point in tk Vmtted States, and onti ofith mott tm- partaia the world! He commeeleaupi mo with which tlis United Slates, which had, in a few months, conquered a great nalior, received and given homes and employment to hundred, of thousands of foreigners, and fed the half of Europe, could construct the proposed Rail road, and concluded with proposing the following resolution, which was unanimously adopted: KAsalmA. That it is one of the Erst duties of the public authorities ot' the nation.to establish military ikwis, from the Western confines of our Eastern Stalea. In the Par-trie Ocean, in Callforna, thai these posts should ba established in all proper places, not distant Irom each otner, and mat civinscu wu Droduclivc ctlleineM should be encouraged mound them, by extending, ample protection to the transport of stores.

So that, by there means, a sate, nractical. but temporary road, with facilities of travel, should be immediately formed tor oui eitiaens across our own territories, from tbe At lantic lo iho Pacifto hore thus foimmt the hrst conoolidaitu band between the Eastern slid est ern extremities of our country. On motion tbe meeting adjourned. Caa. County of Allegheny, Plaiuliff in error, vs.

James A. Gibson, DefendeDt in error, in ibe Supreme Court for fhe Western District of Pennsylvania. This was an action instituted by James A. Gibson, De (Tend ant ia error, Plaintiff below, be fore Andrew Barclay, Eq an Alderman ia and for the city of Allegheny, against tbe error, to recover th value of services rendered by bitnas a road viewer and surveyor.an appeal fronl whose judgmetit was taken to the Court of Com. moB Pleas, and from the judgnteut rendered by that Court in favor of the Plaintiff, a writ of error wm taken by the Defendant below, to the Supreme Court.

The case was argued by Todd and Smith for Plaintiff error, and by R. Woods, Eq for Defendant in error. The only tiuestoa in dispute was, whether a person appointed by the Court of Quarter Sessions, a viewer of public roads, in Aliegoeny County, under the act of 24th April, 1S4S, Sec. 1., vhouaho named as Surveyor by tit Court, is eti titled to receive trom tbe County of Allegheny more then one dollar a day, tbat being the sum allowed by tbe genera! road law to viewers of roads. orrtioN JCanci bell.

Toe cases of Allegheny County and Watts (3 Barr 462) and Com mi doners and Hall (7 290), establish tbe principle, that where services necessary to the discharge af ibe public business, and for which bo rate oi' compensation is fixed by positive law, are rendered by a citizen upon the call of competent authority, the community which has epjoyed the benefit of the service, is liable til pay much as it ia reasonably worth, through its putt- tic agents. But this rule does not obtain where the amount of compensation, is fixed by Statute, end tim mode of its payment pointed out. In such yca.se, if tfce employee be a public officer, the act commonly called the tee bill, positively prohJHs, under a pecahy, the ailowanec of any other or greater than tbat filed by law, but the private individual is equaliy within the pup- view of the (irwtn vs the Cam. of Northum berland, S. aad R.

60. Ia p-urtMiimr tbe enqHiy presented by this case, it uaa therefore make tiff difference in the result, whether tbe plaintiff be low, be regarded as a public functionary during the period of his employment, or as a simple citizen. Tbe act of June 1S36, provides a general method ot viewing and laying out roads nod highways within the cmraoa wealth, by means vtewtrs, lobe appointed by ibe Court ot Quarter Sessions- ia tec. directs that such viewer- skaJi each be enlitlot to receive from the County Treasurer, one dollar ktt each day acccssariiy expeailcd ia the public service. No provision is made tor tbe employment of other ihaa ibat of the 55ta ec, hicli enacts tbat a Surveyor shall be provided and paid by tbe persona applying lor the view.

Under this Statute it is certain tbe county an not be called upon to pay anything beyond the per diem allowance of $1 tpr cacb Then orne the art of April, IMS, which provides that Hereafter the number of road and briL'fce viewers appointed by tbe Court ol Quarter Seamen in the Count lesof Bjiler, Allegheny, Luzurae, Lycom-i and CI: too, t.ha!l be three, odc of whom shall a Surveyor deemed, nereatary, ire. IThi followed by some directions as to tbe manner of viewing and reporting, but notbing said on tbe subject of compensation. Now, ii clear these Statutes are in ymri materia, to be construed together as forming a system and explanatory of each other. Hy the oumberof viewers of roads and bridges in the counties named, is altered, but tbey are left subject to tbe general pro-yiatons of tbe older act, exeept where these are supplied by tbe younger. It follows that there is no change effected in the compensation of viewers, and the provision, that one of them snail be a Seiveyor, if necessary, makes no difference so far as tbe county is concerned.

If hi be entitled lo additional pay, it must be drawn from tbe pocke of tbe petitioners for the road, in pursuance of tne provision of 'be eel of 1 $33. Bylaw, tbe public are bound to pay aeertaia sum; they caoaot be called upon lo pay more. It is scarcely necessary to say that no practice of the County Commissioners which may, heretofore, have obtained oa this subject, can work an increase of tbe common obligation. It may be. that additional legislation ts required on this subject, but if there be a detect, it is not our province supply it.
