M. MoAlpine at the same time and also for assault with Intent to murder Mrs. J. M. McAlpine, who was ahot down.

The other cases are to be tried during tba November term of court The case went to trial Monday morning and the entire week has been consumed. Testimony in the case shews that the trouble grew out of protests made to Mra. Jess Gunn, daughter of Claxton, because she was using water from a drinking cistern to wash with. The testimony of the daughter is that die was abused and that she was soon to become a mother. Claxton, whan told of the trouble, stopped his plow in the field and went home for his gun, lster going toward the Junek borne, but found Junek at the home of J.

M. McAlpine. When Claxton arrived Junak ran in the house. Claxton followed and shot Mrs. McAlpine ai she tried to shut McAlpine waa shot lawn when he remonstrated with Claxton about shooting his wife.
