"It's too late," he replied, locking the door, and grabbing a huntingfishing knife out of a tackle box he had kept in the kitchen. Another witness who was outside the house testified that she heard Rivers yell "don't try to run, I can catch you." Rivers confessed on tape that he then stalked Giles upstairs and found her face-down on the bedroom floor between the bed and a nightstand. She didn't say a word as he approached her. He held the knife with both hands and plunged it into her repeatedly until she stopped moving. "My intent was to kill her," Rivers told police as they arrested him.

Rivers testified in his own behalf yesterday, saying Giles threatened to throw hot grease on him and told him the son he loved was fathered by another man. He said he snapped as Giles came at him with a knife. Then, he said, he blacked out. He also said he lied on his audio-taped confession. District Attorney Stephen A.

Zappala said the case was so horrific that he wanted to seek the death penalty. But he took over the office in January, after the deadline for the state to file court papers to seek the death penalty had passed, he said; i ByJohnM.R. Bull Post-Gazette Stafl Writer Juanita Giles was stabbed 34 times by a jealous boyfriend who had to switch knives after the first one broke off in her neck. The slaying was so brutal that a police officer at the scene had to leave the bloodied room. Even the forensic pathologist who performed the autopsy on Giles' body was shocked.

"I just started whacking on her," Cleveland L. Rivers 43, of Garfield, told homicide investigators a few hours after the killing. "I just kept sticking her until she stopped moving." Rivers said he stopped after the second knife, which he wielded two-handed, also broke. So no one in Judge Gerard M. Bigley's court was surprised when he found Rivers guilty yesterday of first-degree murder, ending a two-day, nonjury trial.

Bigley quickly rejected the argument that Giles provoked Rivers. Rivers' attorney, Joe Williams, sought a verdict of involuntary manslaughter, a lesser degree of homicide. Rivers faces a mandatory sentence of life in prison without hope of parole. Giles, 34, was stabbed 34 times on July 25, 1997. At least 12 wounds were defensive, caused as she tried to fight off the blade with her hands and arms.

She was stabbed four times in the neck, four times in the face, three more times in the chest, once in the belly and 10 times in the back. Rivers and Gfies had a stormy, ll-year relationship. They had both cheated on each other. He had been arrested two days before for punching her. The courtroom was quiet yesterday as prosecutor Kim Clark played Rivers' taped confession, the key piece of evidence against him.

Members of Giles' family -sat with tears streaming down their faces, choking back sobs as they listened to Rivers confess in a factual, dispassionate voice. Rivers sat with his head bowed, toying with a pencil. On the tape, Rivers said he returned to the home they shared in Garfield with her daughter, Marquita, 13, and their son, Cleveland 8, to find Giles frying fish and homefries. They argued loudly about money, about a guy she had been out with two nights before, and the $404 she had given him. When she threatened to send him to jail for violating the terms of his bond, he grabbed the kitchen knife she was using from her hand.

"The next thing I know, I started hacking at her. The knife broke," he said on the tape. "I just started whacking on her. I remember the knife sticking" in her neck and breaking off. Salt shaker in hand, Giles fled up the stairs, screaming.

In the latest twist, Hinzy mailed off an engagement ring to the victim, now in foster care in Maryland, county Detective Jason Hunter said yesterday. She, in turn, has named the child after Hinzy. But any future relationship could be problematic. First, there's Hinzy's Somerset County jail sentence.

Then he must stand trial on four charges in Garrett County, where investigators say he continued to molest the teen-ager late last year. Finally, there's Fike's order yesterday that Hinzy have no contact with the girl unless it's to arrange custody or child support. Last month, Hinzy pleaded guilty to endangering the welfare of a child, two counts of statutory sexual assault and a charge that he escaped from the county jail Feb. 20, walking out an unlatched door the day after he was arrested in the molestation case. He fled to his parent's home five miles away and was returned to jail by his mother three hours later.

"I'm sorry for what happened," Hinzy told Fike yesterday. "I made a mistake." A different county judge, Kim Gibson, sentenced the girl's mother Tuesday to 18 to 48 months in prison for endangering the welfare of a child, corrupting a minor and an unrelated shoplifting charge. The woman is not being identified by the Pittsburgh Post-Gazette because doing so would identify her daughter. "The evidence indicates that she knew about the relationship between her daughter and Mr. Hinzy.

It was not surreptitious in any way," Johnson said. "Her skull had been found about three-quarters of a mile downstream from the remains we found in March. I assumed the stream had carried away her other bones. We searched that stream and adjacent hillside very carefully for half a mile, but we didn't find anything. "I think the Katterson family found the bones on private property. We didn't search there because I didn't think we had permission." Dirkmaat said this was the first time in his career that anyone had recovered bones after he and his students had searched an area.

"I feel for Patricia Katterson," Warco said. "I'm a parent, too. A lot of dedicated people spent hours looking for Sandra's remains after her skull was found. Somehow the bones she found were missed." Katterson, who sent a letter to the Pittsburgh Post-Gazette explaining what had said the Lawrence Miller Funeral Home in Bellevue would pick up the bones from Warco's office today or tomorrow. The Katterson family is offering a $20,000 reward for information leading to the arrest and conviction of the whoever is responsible for Sandra Katterson's death.

To the law, she is David Hinzy's victim, a teenager he molested for a year, the girl who was a month shy of her 15th birthday when she gave birth to his child. To Hinzy, she is his 15-year-old wife-to-be. Hinzy made the formal announcement yesterday before Somerset County Common Pleas Judge Eugene Fike II sentenced him to II 2 to 23 months in the county jail for molesting the girl and breaking out of prison. "We're engaged to be married," Hinzy, a lanky man whose distinguishing feature is a "born to be wild" tattoo covering his forearm, said as he stood before Fike in handcuffs and leg irons. "They do plan to get married," public defender Kenneth Johnson confirmed.

It was another twist in a case knotted with them. Hinzy said during a preliminary hearing in April that he began having sex with the girl in 1996, while he was living with her mother, now 33, and continued with her blessings. The mother had been surgically sterilized, and selected, her daughter to have a child with Hinzy instead, the victim told investigators.
