Columbus, Twaas, Oetober I In th cans of th Stat of Texas vs. Gregorlo In which th defendant was charged with the murder of Sheriff R.

M. Glover of Gonsales county, snd la which be was envlcttd of murder In the first degraev and sentenced to Ufs imprisonment, the defense today filed at 4 p- m. a motion for sew trial. The motttn was based on the following grounds: That the court erroneously overruled the defendant's application for continuance, which application was bad an the absence of three Mexican claimed to be eye witnesses of the killing or Glover. Thst the court erroneously admitted, over defendant's objection, evidence of the killing of Sheriff Morris of Kernel county by defendant three before the killing of Glover That the court erred In admitting evidence of the confession of Cortes In the San Antonio jad, because th defendant claimed that ho had not seen sufficiently warned to render said confession admissible.

After assigning several more grounds of error In admission and rejection of. evidence, the defendant assigned numerous grounds of error in the court's charge. The defendant then assigned as ground for new trial the action of the State's attorney in argument, claiming thst the Btatow attorney said that Ro-maigom, brother of defendant, was dead, and that his family could not be found to testify against him, snd that the defendants mouth was closed. Defendant objected to said Jlne of argument on the that aa hs had not taken th stand In his own behalf this wss a violation of the law forbidding th State to allude to the failure of tb defendant to testify. The defendant further stated thai on the trial of the cause the defendant did not have a fair and Impartial trial, because the court room was filled with Influential cltlsens of Gonsal county, some of whom were subpoeuaed by th But and were not placed on th stand, nor placed under th rule, but were merely subpoenaed to Influence th Jury; that three eillsens war present taking an active part In th trial of the cause In behalf of the State, doing all in tneir power to influence th jury against defendant.

That la the argument of the caess, tlr, Hopkins dosed the case for ths Stats, alluding in las argument to th defendant as "a Mexican burse thief, a red-handed, murderer and sheriff -slayer," etc, and called en the Jury in the name of the most Influential cltlsens of Gonsales county here Mumbled to hang the defendant, to all of which argument the said Influential cltlsens responded by miles, nods and sxpresslona of approval, thus influencing the jury again! the defendant The Bute filed affidavits showing by various dtlsens of Oonssles county that ths wtineeeMi for whose absonos continuance was seked had been for a long time In Mexico snd that th defense knew this or could hsve ascertained It by Inquiry. After the filing of a few counter affidavits by the defense snd argument by counsel, th court overruled the motion and the defense gave notice of appeal. SAENGERBUttD DAY. 'The Singer.
