Now, Mr. Editor, these offices, to the parties, amount to very little in regard to honor or profit bat as it respects the community, it amounts to a big thing, especially the "Assessor. Now the editor of the Commercial thinks he has read law enough to settle the question, no mistake.

I propose now to examine his authority. Now I submit to the judgment' of any man, has an eleotion any binding force that is aot held pursuant to law, though a majority of votes may have so de-elared their wishes. I think the whole question turns on that one point in the J.

Bronson decision, and all other decisions, referring to the same point. Was the late election held pursuant to law? If so, there is no vacancy. If not, there is. Not pursuant to the law of N. Y.

Section 3, page 404, Rev. stat provides "That the Trustee and any two Justices of the Peace shall act as judges of the eleotion." Section 7, page 1033. provides the same, and says, "they shall conduct the said- election in all other respects es other electioos voder the general electionl laws; they ahall meet by 10 o'clock in the morning and appoint two clerks for each eleotion; and should the said trustee and justices, or either of them, not be present at. the place of holding aaid electioa, by 10 o'clock a.

then the electors shall proceed to elect judges and clerks from those present viva voce, who shall be judges and clerks of said election. They shall also take an oath to faithfully discharge their duties as judges and clerks of said (township) election. Now I would ask the editor of the Commercial if any portion of these provisions of law were complied with in the last township eleotion I answer, no. There Was neither trustee nor justices of the peaoe present; neither did the persons present, by viva voce, elect judges or clerks; neither were either judges orolerks sworn to impartially or otherwise hold a township election. Was that in pursuance of law See.

4, page 404, says "The trustee of each township shall provide a ballot box for each lection distriot, and carry it to the place of holding an election, together with a copy of the laws eontaining this act." Waa this provision of law complied with Not a bit of it. It is true, as Eaton says, that in two of the Wards there were two boxes, and a counoilman told the judges of the First Ward to put the negro votes in one box and the votes of the whites in another; and they did so. Now, Mr. Commercial, was that in pursuance of law? Sec. 20, page 410, provides 'that the judges shall put under cover one of the poll books, seal the same and direct it to the County Clerk of the county, where the return is to be made, together with the ballots, sealed as herein before required, and shall be conveyed by one of the judges to the clerk of the county within two days from the day of the See.

27, page 410, provides "that the judges shall preserve all ballot and de liver the same to the County Clerk to be filed in his office." Was it done Not one provision waa complied with. Was that in pursuance of law NowMr. Commercial, what was the duty of the Board of County Commissioners under their oaths? They first examined all the returns of township elections outside of Leavenworth. When the clerk came to Leavenworth, Instead of having the poll book as in all other townships, he reported there was no returns from Leavenworth township. It is true the City Couneil bad by resolution told Madden to tell the County Commissioners who was and who was not elected The county commissioners very wisely conoluded that Mr.

Madden had no more right to tell them who was elected and who was not than Jacob Martin, or any other man; and so they deolared in pursuance to law, there was "no election held in Leavenworth township; and consequently there were vacancies in the offices of Assessor, Justice of the Peace and Constables; Now, Mr. Commercial suffer me to tell you the reason why there was no township election pursuant to law. The great city election teing so important and the township eleotion so insignificant, that the officers whose duty it was to see that the election for township officers should be held pursuant to law entirely forgot it; and after they found cut they bad blundered in the matter they try to lay the blame on the board of Canvassers. How unfair, not to say unjust, to make them the eoape goats to carry off their sins. Oh, yes, they should have canvassed the votes when there was not a single vote to canvass.

They should have declared who was elected when there was no election returns. In fset Mr. Editor of the Commercial, there was no township election. The election held on the 5th of April was a city election, held by judges appointed by tbe Mayor of this city; the ballot boxes were city ballot boxes; the poll books were city poll books, and returned to the city clerk, all in pursuance of law. Now, in eonclusion, what inference is to be drawn from the reasoning of the Commercial Simply this: That an eleotion held without judges, clerks, ballotlboxcs, poll books or re turns co tne proper officer, is a small informal ity, and will not vitiate tbe eleotion.

Such reasoning is, to say the least, simply nonsense. ITAl FLAT. Fire. Yesterdsy at half.past 12 o'clock a lire broke in a wooden shed or stable in the jail yard. and before the flames oould be subdued, it was burned to the ground.
