The commissioners acted on the opinion and ordered the office abolished, dating from yesterday. The commissioners, however, refused to allow the claim and stated that would be necessary to establish the validity of the claim by means or a law suit, before It would be favorably considered. The action of the commissioners has given rise to variety of opinions. It is pointed out by those who are opposed to the action, that it was evidently not the intention of the legislature to deprive the commissioners of the right to appoint and pay a deputy clerk of courts, when in their opinion, a necessity exirts, and that the working of the statute does not Indicate any surh intention.

They admit that there are times, when the work of the clerk of courts office may possibly be handled by one man, but on the other hand, they contend It will be absolutely Impossible to handle the office, during sessions of the circuit court, at which time It is necessary for one official from the office to attend personally such sessions; this would leave the office unoccupied by an official during the time court was actually In session.
