Smith shot both of the robbers down after Davis fell. INDIANS MUST REFUND CONTRACT PAYMENTS Government Will Force Them to Sell Land and Reimburse Dealers Who Advanced Money Dallas, S.

Feb. 24. Through a peculiar undertaking of the United States government now in process of execution by Superintendent John B. Woods, in charge of the Rosebud Indian reservation, certain land men and investors in this section stand to recover sums variously estimated as aggregating between $25,000 and $50,000 which has been paid to Individuals of the Rosebud Sioux tribe as earnest money for the purchase of their lands to which title was never secured. Several years ago the practice of contracting directly with the Indians for the purchase of their allotments and trusting to Influence of luck for the Issuance of the patents by the government became so general and flagrant that two years ago the Interior department made a thorough Investigation of the matter, with the re-result that about 20 applications were rejected at one time and very few Rosebud Indians have been able to secure patents since.

It was generally understood and conceded that these contracts were In direct violation of the federal law and that all payments made thereon were uncollectable by land. Government inspectors have sought out every person who made such a contract with an Indian and secured quit claim deeds for the future protection of the latter. Now the government proposes to compel the red men and women who accepted money on such contracts to repay It by permitting the sale of the lands for the purpose. Mr. Wood has met a large number of Indians In Dallas for the past few days for the purpose of ascertaining how much each owed for moneys thus received and arranging for the sale of lands with which to discharge these debts.
