James Zwick, 31, went to court to enter the state's Accelerated Rehabilitative Disposition program. Participation in the program implies that a defendant is guilty.

But when scores of defendants in other cases raised their hands to swear to tell the truth, Zwick stood near the door with his hands at his side. James Wymard, his lawyer, said the commissioner wanted to enter the rehabilitative disposition program without admitting guilt. Robert E. Dauer, president judge of Common Pleas Court said Zwick couldn't do that. "By accepting the ARD program, you are implicitly admitting that you committed the offense with which you are charged," he said.

"I cannot constitutionally, punish somebody for something he did not do," Dauer went on. "If the person says he's not guilty, then he should go to trial." Zwick's case was assigned to Common Pleas Judge Raymond Novak, who will schedule a trial date. Sun. 2-4 7-9 pm Woman held in knifing A man who is hospitalized and the woman accused of stabbing him will face criminal charges following an altercation early yesterday on the North Side. Michael Wright, 20, of Race Street, Homewood, was in fair condition yesterday in Allegheny General Hospital, a hospital spokeswoman said. Polce said Wright was stabbed about 12:45 a.m. at a residence on Tetrow Street North Side, by Dana Oree, 21, of Washington Boulevard, East Liberty.

After the incident, Oree was pulled over by officers as she drove Wright's white Cadillac on West Ohio Streef Police said Wright assaulted Oree, who was treated at St. Francis Central Medical Center for facial and head bruises and a bloody nose. She was being held on $300 bond last night in the Allegheny County Jail on charges of aggravated assault and reckless endanger-ment. She faces a City Court hearing at 9 a.m. Jan.
