Hound Over to Court on Charge of Manslaughter Au Unusual Caw. IjOUiKburg, Nov. 19. The accidental shooting recently of Charles Hunt, a negro, by William Horton, on Mr. W.

H. Allen's land, took on a new phase yesterday. A warrant was sworn out by Clara Hunt, widow of the deceased, against Mr. Horton for murder, and the hearing took place on Thursday afternoon before Justices of tbe Peace Ellis and Baker. The defense was represented by Messrs.

W. II. Ruffin and F. S. Spruill, and the State by Messrs.

W. H. Yarborough, and T. Blckett. The trial resulted in the defendant, Horton, being bound over to next term of Superior Court In the sum of 1100.

Some interesting points of law at least to a layman, were brought out during tbe trial. It developed that the dead man was on his own rented premises at the time of the shooting, and that Mr. Horton' was hunting on Allen's land without his consent, -as permission had been asked and refused. The killing was admitted, knd the evidence showed conclusively that It was the deceased being mistaken for a turkey that Horton thought was approaching him In response to his call. But It was contended by the State, and the law as read by them Is usually plain, that a man.

If hunting on anothers land In Franklin county without his written consent, Is guilty of a misdemeanor, and while engaged in such trespass, should he kill another man, though accidental, is guilty of manslaughter. In other words, if a man, while himself engaged In the commission of a felony, should accidentally or otherwise kill another, he Is guilty of murder, and If himself committing a simple misdemeanor and should accidentally kill another, he Is guilty of manslaughter.
