1 The Sun SATURDAY, August 18, 1990 Court to review sentence in Daggett death Edison will bury lines on Waterman Avenue a Baker service station and taken to an abandoned shack near Daggett, where she was beaten to death. An accomplice, Michael Crenshaw, 28, of Berkeley, testified at a pretrial hearing that Malone had done the beating. Crenshaw was sentenced to 25 years to life in prison. The high court said in its 1988 ruling that Malone was also convicted of murdering a second woman in the desert, and there was evidence to connect him to murders in St. Louis and Kansas City, before he was caught.

The order granting a hearing was signed by Justices Edward Panelli, David Eagleson, Joyce Kennard and Armand Arabian. The Associated Press contributed to this report. The court said it would examine defense allegations that a juror, during pretrial questioning, had concealed her knowledge and views about the reliability of lie detectors, and had later told fellow jurors that her research as a psychology teacher showed her lie detectors were unreliable. Justices also said they would look into allegations that a prosecution witness, Charles Laugh-lin, had been promised something in exchange for his testimony, had failed to disclose the promise, and had testified falsely about the facts of the case. Deputy Attorney General Jay Bloom said Friday he will respond to the defense allegations within two weeks, arguing there was no juror misconduct nor false testimony by McLaughlin.

"We don't think evidence supports the argument that a juror concealed her views on lie detectors," said Bloom, who is the state's appellate attorney in the case. "And our position on Mr. Laughlin was that he testified truthfully at the trial and said that he wasn't promised anything." The Supreme Court has three options: to grant or deny the defense's request to consider the issues or to order an evidentiary hearing. "I can't predict what the court will do," Bloom said. "If there's an evidentiary hearing, it would probably be held within several months." The justices agreed Wednesday in San Francisco to take another look at the death sentence of Kelvin Malone, 29, now on San Quentin's death row for the bludgeoning death of Myrtle Benham, 65, who was abducted from a Baker gas station in March 1981 and was killed near Daggett. Her murder was the fourth attributed to Malone during a six-day, Missouri-to-California crime spree. He received a life sentence in Riverside County for killing a 55-year-old woman, and was connected to two Missouri murders, authorities said. The state Supreme Court upheld Malone's death sentence on a 6-1 vote in November 1988. On Wednesday, the justices agreed to consider new issues raised by Malone's lawyer, alleging misconduct by a juror and the prosecutor.

The men have two dozen more poles to climb before they finish stripping overhead wires along a half-mile of Rial-to Avenue, one of the city streets where power lines will be transferred underground. Waterman Avenue is the next on the list of streets that will lose their power poles in the next two years.

Edison workers will begin placing wires underground on Waterman from Ninth Street to the Santa Ana River Sept. 4, during an eight-month, $5 million project. The company warns that the project will slow traffic on the busy street. One lane on Waterman occasionally will be blocked in each direction, but the other lane will be open, said Jim Burns, Edison area manager. "There will be times when the lanes will be reduced to one.

But we are going to try to minimize that." Burns said Edison will try to keep both lanes open as often as possible. Mayor Bob Holcomb urged residents to use alternate routes between 7 a.m. and 3 p.m. "It's a major underground project," Holcomb said. "This is a short inconvenience and it will add to the aesthetics of the city.

I don't think there will be many complaints." Edison is working to maintain a steady traffic flow on Waterman despite the amount of excavation equipment that will be on the site soon, Burns said. The crew of five that worked the $500,000 Rialto Avenue project between I and streets knocked down about 10,200 feet of wire from poles Friday. They labored three hours to strip each pole and another four hours to clean up the wires on the ground, said lineman Jim Stapp of Edison's Foothill District. Another crew will climb 80 poles along Waterman next fall, but that part of the project isn't expected to impede traffic for long. After the Waterman poles are stripped of wires, a crane will be brought in, Burns said.
