Donnelly Divides an Berkeley aud Alameda Mes. Philip Boogar died in. his room at 12:26 yesterday afternoon from the effects of the wound in fi cted by Michael Collins, his father-in-law, in front of the Galindo Hotel on Tuesday night at 7 :15 o'clock. At 2 o'clock yesterday morn- ins he signified a desire to draw up a new will and sign it. His attorney, J.

11. Smith, was called, but on entering the deatb-cbamber Smitn at once stw the usplessnega of bis visit. Mr. Boogar was ton feeble to tell his friend what wanted, and so tbe matter was dropped. At 9 o'clock it was decided that an operation would be the only possible chance of saving his life.

Dra. Miller, Olmstead, Woolsey, Paterson, Leech and Mullen were summoned ami the operation began. It occupied about an hour and a halt. The abdomen was opened and the larger arteries which supply (be bowels were tied. They had beeu cut by the bullet nnd allowed internal hemorrhage.

One of the intestines was nearly severed and was reunited by a lateral anastauiosis It is something new, and is the first one ever performed in Alameda County. The loss of blood and shock was more than Mr. Boouar could rally from ana tie soon afterward died, lie was conscious up 10 the last minute Coroner Baldwin was notified, and at once removed the remains to the Morgue. Attorney Smith nt asked', an to the statement made ttiat Mrs. Boogar had been watched by detectives for the past two years.

He said: is not a word of truth in it. In the two years there may have been (wo months' detective work done, but no more." When asked whether he thought the shooting was premeditated lie replied: "Well, I went down to tbe Gallndo Hotel the day before and while (line 1 saw Mr. Boogar. It looks kind of The causa of ail ibis trouble dates back to May 16, 1893, when Catherine Boogar asked for a divorce, division of property and alimony. Before this a like suit had been filed, but dismissed on a compromise of some nature. She also bad Boogar arrested on a charge of attempting to poison her. lie was acquitted. Next came an attempt to have Boogar declared Incompetent and a guardian but Him was abandoned.

Boogar tiled a cross-complaint iv the divorce suit, cb.uglnz his wife with being unchaste. lie obtained some affidavits to suppore his claim. The deposition of Charles Lf slier, a urivate detective, ma filed December 28. It was taken at Itedlands and has relation to tbe allegations In tbe complaint against Mm. Boogar.

It was received by the County Clerk last week. Mrs. Boogar called at the office of tbe County Clerk and asked for It last Wednesday, and nf er getting an order from her attorney one received it. Mi. Collins, her father, was with rat the time and tbe two took a seat at ot tne reporters' tables.

She read to Dim for some time, and it is believed that the allegations tv tbe deposition had great effect upon bis mind and may have spurred him to do the deed, probably thinking Boogar respousible lor the threatened disclosures when tbe case should come to trial. The divorce suit was to have come up to-morrow In Judge Greene's department. Attorney George A. Knight of San Francisco has been retained by some of Collins' friends to defend him. he was informed by a lady who called at the City Prison yesterday afternoon.

The trial of Charles Becker for the murder of C. A. Kdson, formerly proprietor of Hie Terrace or Alnmeiia, was enlivened by several unusual yesterday. During the H. ishuler, an Alameda brewer who was a witness in the case, disobeyed the order to remain outside the couitroom.

Later the testimony became somewhat monotonous and during the examination of a witness Juror La Prince leaned back in his chair and closed eyes. The drowsy air of the courtroom sealed them and he dropped asleep. He had been lost in dreams for some moments when his condition was discovered. Bailiff Dutton roused the sleeping juror.who had lost track of the testimony, and the court reporter was required to read it up from the point at which the juror fell asleep.

The principal witness of the afternoon was Mrs. Becker, wife of the accused, who related how her husband had been repeatedly put off by Edson when he demanded his pay. Becker was finally compelled to mortgage his home to meet his bills. The People's Convention. The People's party in Oakland will hold a city convention on Monday 'evening, January 28, to nominate a ticket to be voted upon at the city election of March.

Mr. I Carton consulted with Makins compared notes, wrote to the postmaster of Hartford and exposed the fraud. The writer lias Deen arrested and proved to be a boy sixteen years of ace named Itoscoe Birch of Dowauiac, and has 'confessed the forgery of the name of George W. Merrtman.
