Gen. Vito Miceli, head of Italy's military intelligence agency until July, has been placed under investigation on suspicion that he attempted to bury his agency's findings on the plots. James Earl Ray renounced his pica of guilty and started a legal bombardment proclaiming his innocence. Now, more t h a n . 5-years into his 99-year sentence,' he will have a new day in court. U.S. District Judge Robert M. UcRae Jr. will open a hearing Tuesday on whether Ray is entitled to withdraw his guilty plea and stand trial for murdering the civil rights leader on April 4, 1968. The issues will be whether Ray, 46, had effective counsel when he pleaded guilty and whether his admission was freely given. Robert I. Livingston of Mem- ihis. who has helped represent Slay for five .years, said "Our contention is that there was a definite conspiracy and that Ray was set up as a fall guy and was not a part of the conspiracy.". James H. Lesar,. 34, of AVash- ington, D.C., who has worked in defense of Ray for four years, says he will try to show Ray was denied evidence on his guilt or innocence. Two major figures in the case, famed criminal lawyer ?crcy Foreman of Houston, Tex., and Alabama author Willam Bradford Huie, probably won't appear, attorneys say. They already have given sworn statements. Foreman represented Ray when Ray pleaded guilty. Ray's new attorneys claim that his first lawyer, Arthur Hane s Sr. of Birmingham, Ala., agreed.to represent him in exchange for 40 per cent of all royalty · rights to Huie's book, "He Slew the Dreamer." When Ray fired Hanes four months before the trial, he hired Foreman and agreed to assign him 60 :per cent of the .expected book royalties to cover legal fees, Ray's attorneys say. They contend that Foreman pressured Ray to plead guilty in order to avoid a public tria'l and preserve the economic val- ue of the book. Foreman and Tiule have denied they sought .0 profit from Ray's case. Ray, who escaped in 1967 'rom the Missouri state prison ·vhlle serving an armed robbery sentence, was arrested at London's Heathrow Airport on June 9, 1968, 69 days after King was slain as he stood on the second-floor balcony of the Lorraine Mote|. King was in Memphis in support of a sanitation workers' strike. Livingston said that while there was a conspiracy, Ray did not know about it before the shooting, and Ray "did not fire the ehot..." (AP) -Rep. Bill Alexander, D-Ark., said Saturday he would like to assure President Ford that Alexander is "one Democrat who will cooperate 110 per cent as ong as the proposals he makes are in the best interest of the people of Arkansas," Alexander made the remark during the dedication of a $60,100 community center at Scot- and in Van Buren County. The remark was in response to Ford's statement that he needs more Republican congressmen to help him fight inflation. The center "is evidence of new life in rural ^reas," Alexander said. "In my way of thinking, every town in America needs a community center so that people who live in the non- metropolitan areas can enjoy one another, can have a place to meet, can have programs that will be of social value to the citizezns, and also provide a place for the young children to begin their start in life," he said.
