Mrs. Lollar has filed a sim- ar suit against L. E. Lay o., also a subsidiary of FAB- 0, in U.S. District Court for he Eastern District of Texas. · The Little Rock suit said Irs. Lollar had borrowed mon- y from L. E. Lay against the ecurity of a mortgage on some eal estate. To obtain the mortgage, she tad to agree to maintain an es- :row account through L. E. -ay, the suit said. Each month he must pay a part of nor annual insurance premiums arid property tax payments Into the iccount, which does not earn nlorcst, the suit said. The suit alleged ttiat this arrangement constituted an illegal tie-in because a borrower :ould not borrow any money rom L. E. Lay without main- aining the escrow account. Tic- ns are prohibited by law on the ground that they constitute a restraint of trade. Mrs. Lollar said If borrowers from L. E. Lay did not have to maintain an escrow account business firms might develop that would compete for this money and, perhaps, pay inter est on it. Under the existing arrange ment. FABCO and Worthen use the money until annual pay ments are due without paying nterest, the suit pointed out. The suit was filed in behalf of all persons who have borrowed noney from L. E.
