The public expression of differences in opinions is something to be expected and encouraged in a democracy."' He cited the Louisiana Supreme Court case in which the justices said that "every person has the right to comment on matters of public interest snd general concern, provided he does so fairly and with an honest purpose. Such comments arc not libelous however severe in their terms, unless they are written intemperately and j maliciously." ' Cocke said his own comments made In the reasonable belief of th'e truth thereof, regardless of whether they are true or false." He held that malice "is a necessary element In the crime of defamation." If the» statements printed ar e false, malice may be implied unless a justifiable motive for making it is shown, Cocke said.
