Cummins Inmates And Guards Are Urged To Keep The Peace LITTLE UOCK (AP) - Judge, J. Smith Henley of U.SI District Court here Wednesday urged guards and inmates:at the maximum security unit of Cummins Prison Farm to keep the unit peaceful until he rules on hearings held on conditions at ,. the unit. . During the hearings, inmates alleged that they had been illegally maced and beaten by prison guards. The hearings, which began during June; had been recessed .until Monday T. The state had :been.scheduled to wrap up Us defense Monday. Instead, in. mates presented more testimony on allegedly illegal beat. ings that had occurred during the recess. The inmates have testified that they were gassed or beaten for no reason, while the guards have testified that any force they used was jusified. Beatings took place, they said, only to subdue .inmates or recover weapons from them. Davis William James, 21, o. Gould;, testified.Wednesday that he had quit his job as a Com mins guard after 13 months be cause th'e; inmates couldn't be controlled. He said the only so lulion was for the guards to bear down! harder on the in- nates. An inmate, · James Spencer, estified that the guards retaliate against inmates who com)lain to the court about mis- '.reatment. Henley asked both sides Wednesday to submit briefs by the end of July on their legal arguments. He said he wouldn't render a decision until he had heard a ruling for the. U.S. 8th Circuit Court pt Appeals .on another Arkansas prisoner case. The appellate court recently outlined in a prisoner case from another state what procecures prison administrations woulc liave to follow before disciplin ing an inmate.
