40 0 NorittwMt Arfcomai TIMES, Sunday, July 7, 1974 ARK»N*»t Federal Case Merits Not Applicable LITTLE ROCK (AP) -- Attorney Eugene Warren of Little Rock said Saturday he did not think the Senate must consider th;rrjerils of a federal case in which Sen. Guy H. "Mult" Jones of Conway was convicted before deciding whether to expel 'Jones from the Senate. Warren has been hired by the 10-member committee, which is investigating Jones' qualfica- lions to serve in the legislature, to create procedures for the Jones inquiry. Jones was convicted in U.S. District Court in December 1372 of four federal income tax charges -- Iwo counts of filing false returns and two counts of income tax evasion. The charges are federal felonies. Warren said Saturday he thought he would be ready Monday to suggest the rules and procedures to Ihe committee on how to protect both Jones' procedural and substantive rights under due process of law. In an interview, - Warren salt he did not think it would be necessary for the Senate "to go behind" Jones' conviction. Article V, Section 5 of the Arkansas Constitution · says no person convicted of "embezzle mqnt of public money, bribery forgery or other infamous crime shall be eligible to the General Assembly of holding any office of trust or profit in this state." Warren also said "there ar · lot of complicated legal ques tions that will remain after th rules of procedures" are deter ~" mined. He declined to commcn on these questions. Warren made' the comment when asked if he thought th Senate would have to decid the Jones case on the basis o record of the conviction and re la ted matters of record o would it have .to start from scratch and consider the merit ef the federal case. Warren said he had bee asked this earlier and added "That was one of the question Hiat gave me considerable of handed trouble. Warren also said Jones mus be given due process of la since the senator's unexpire term i s - a "property" right."
