until destroyed then shot him five times Miss Austin has testified in state Supreme Court Alternatively smiling and frowning she told a jury Wednesday how she shot Jay Jacobs 51 on Dec 15 after arguing with him at the ifth Avenue law office of Burke Burke where he was a partner and she a typist Miss Austin told a jury that Jacobs a married Greenwich Conn man with whom she was having an affair had wanted to take nude photo graphs of her and had threatened to fire her if she refused to have sex with his clients After the shooting she took several sleeping pills and back to my a psychiatric facility until doctors judged her sane Staten Island secession bills to be unveiled ALBANY (AP) or months a powerful state senator from Staten Island has been railing against what he calls without represen tation" in his home region Today state Sen John Marchi Staten Is land will unveil legislation that would be the first step towards allowing Staten Island to secede from the rest of New York City Marchi the chairman of the Senate's power ful inance Committee has been leading a movement to study the feasibility of separating Staten Island from the rest of New York City His effort increased after the US Circuit Court of Appeals ruled in May that the constitu tional person one vote" rule be applied to the city Board of Estimate Marchi said the ruling which has been sent back to a lower court for further action would give Staten Island virtually no voice on the board which largely determines how the city spends its money The court decision would give proportionately more representation on the board to New larger boroughs Queens Brooklyn Manhattan and the Bronx As the latest step in his fight Marchi plans to unveil bills today that would allow the secession and determine whether Staten Island should have a city or a county form of government according to Marchi spokesman Gerald McLaughlin "There's academic and historical significance to this" said McLaughlin "but it's not something that will explode tomorrow with people putting on Confederate uniforms and going to war" He said the secession movement is mainly a contingency plan in case the circuit court ruling withstands legal appeals desire for a secession debate in creased after voters approved a New York city charter amendment Nov 8 that will allow the mayor to largely control redistricting of the city council after each federal census Marchi said that measure could virtually eliminate Staten Island's representation on the council The senator said finance committee studies have indicated it both politically and financially feasible for New York City's smallest borough to strike out as a city on its own Island has had one vote on the Board of Estimate since it was formed in said Koch tax incentives NEW YORK (AP) City Council lead ership has formally told Mayor Edward Koch it wants changes in proposals he has made for granting tax incentives to businesses The council which almost routinely passes Koch administration bills took the rare step Of sending the mayor a letter signed by Democratic Majority Thomas Cuite of Brooklyn and Coun cilman Archie Spigner of Queens who chairs the Committee on Economic Development While the council leadership and the adminis tration usually confer informally on matters requiring council approval it is for Cuite to write to the mayor personally according to Joseph itzpatrick a spokesman for the council Cuite and Spigner said in a letter dated Nov 14 that several changes should be made balance should be struck here between the importance of certainty to the business commu nity and the importance of safeguarding the taxpayer's the letter stated The letter said the council leadership objected to the elimination of the Industrial and Commer cial Board and the granting of automatic tax incentives to most new business construction or renovation outside the inancial District and the midtown office core element of discretion should probably be in the program the officials said Kenneth Lipper the deputy mayor for finance and economic development said the elimination of discretion in granting incentives was vital to the administration proposals Relief fund started for Baby Jane parents JERICHO NY (AP) of the parents of Baby Jane Doe the severely deformed infant at the center of a court fight between her parents and the Reagan adminisration have set up a fund to help defray mounting medical and legal costs it was announced Wednesday Lee Kilbrith an accountant who has been a friend of the parents for 10 years said they already face $6000 in legal expenses in their fight against the federal government expect fees and costs to rise a lot higher before this fight is Kilbrith said The parents who have not been identified oppose life prolonging surgery for their handicapped infant who has spina bifida a tiny skull and water on the brain and is expected to be bedridden and severely retarded for her entire life The child is receiving conservative treatment at Stonybrook Hospital Last week US District Court Judge Leonard Wexler ordered attorneys for the hospital and family to respond to the request for the medical records within four days instead of the normal 20 day period The response was made but Kilbrith said it forced the attorneys to add five additional lawyers to their own staff to work around the clock in order to have their response done in time Kilbrith said a few telephone calls have been received by the office from people inter ested in contributing to the family said any money left over from the legal costs would be used toward the medical costs for the baby A hearing was scheduled for Thursday at US District Court in Uniondale on the federal govern request for the medical records The government said it needs the records so that it can be determined if the 5 week old civil rights have been violated Tram service suspended The aerial tramway serving Roosevelt Island will be shut down for 10 days for routine maintenance beginning at midnight riday state Housing Commis sioner Yvonne Scruggs Leftwich says She announced Wednesday that the tram would resume service at 6 am on Nov 28 In the interim bus service will be provided between Motorgate on Roosevelt Island to 59th Street and Second Avenue in Manhattan she said Bus schedules are being provided to residents of the island and will be posted at the tram terminals and in the lobbies of island buildings The bus fare will be 75 cents each way ree mini bus service will be provided to hand icapped residents hourly from 7:30 am to 10:30 pm daily from the island to 60th Street and Second Avenue The mini bus also will be available to school children Monday Tuesday and Wednesday Man dies in crash EAST ROCKAWAY NY (AP) An East Rocka way man was killed when his car crashed through a barrier at Rhame Avenue and West Boulevard plung ing into a canal Nassau County police said Police spokesman Paul Kunz said Stefan Mader 41 was pronounced dead at the scene at 9:04 pm Wednesday after county police divers pulled his body from the submerged car Kunz said the cause of death would be determined temporarily barred the city medical examiner from disposing of the and of Michael Stewart a man whose family charges he was beaten to death by Transit Authority police State Supreme Court Justice Andrew Tyler barred the medical office which performed an autopsy on Stewart from disposing of the specimens and microscopic slides used in the autopsy until he rules on request for them Lawyers for Millard Stewart want Dr Elliot Gross the chief medical examiner to turn over the materials to the privately retained doc tors Dr John Grauerholz and Dr Robert Wolf they can perform their own analysis The attorneys also said in court papers that they wanted the specimens in order to obtain information needed file a timely notice of a document informing the city of a lawsuit A Manhattan grand jury
