Ferguson III of Uniontown and his arrangement with Baltimore Life Insurance Co. Matthew Cahalan, president of the Catholic Family Security Association, the subsidiary marketing the plan for the Catholic Cemeteries Association, said the Ferguson case will be reviewed to see if it has any impact. Some of their competitors have contended the arrangement is illegal, and believe their position could be strengthened by the court ruling. No formal complaints have ever been filed against the cemeteries association's marketing of the Catholic Funeral Plan, and the association has denied any wrongdoing. A three-judge panel of Commonwealth Court did not prohibit arrangements between funeral directors and life insurance agents, but it emphasized that discussions with a consumer about merchandise and services should be carried out by the funeral director. Presumably; the insurance agent could only handle the general financing of the plan.

Commonwealth Court issued its opinion Monday concerning arrangements between funeral homes and life insurance agents to sell "pre-need" packages to consumers planning for the future. The ruling upheld decisions last year by the State Board of Funeral Directors, drawing a line that insurance agents may not cross in selling the future plans on behalf of funeral homes.
