family resi dential use 4 In conjunction with this minor subdivi sion Applicant seeks variance relief for each of the proposed two family dwell ingsallowing (a) Uncovered steps to project 9 feet into the required front yard where a maxi mum projection of 6 feet is permitted un der Ordinance Section 17 823 A7 (b) A second and third floor overhang to project 2 feet into the required 20 foot front yard and (c) A rear yard setback of 15 feet where a minimum rear yard of 25 feet is required 5 The Board finds that the minor subdivi sion application meets all applicable sub division and 2 1 zoning requirements and should be approved 6 With respect to the requested vari ances for the proposed overhang projec tion the board finds that this architectur al treatment will help provide the pro posed dwellings with an attractive and varied appearance The Board also finds that the projection will not unduly Inter fere with light and air or front yard parking The Board concludes that the benefits of granting this variance will substantially outweigh any detriment and that relief can be granted without substantial detriment to the public good zbne plan and zoning ordinance 7 With respect to the requested vari ances for the protection of uncovered front steps the Board finds that the en hanced projection will facilitate safe in gress and egress and an attractive and functional building design The Board finds that there will be minimal addition al mass within the requirred front yard The Board concludes that the benefits of granting the requested variance will sub stantially outweigh any detriment and that relief can be granted without sub stantial detriment to the public good zone plan and zoning ordianance 8 With respect to the requested rear yard variance Applicant presented testimony indicating that the proposed dwellings are to be occupied by his two sons and their families Joseph Dominguez one Ap plicant's sons testified that the rear yard setback variance was needed to provide a third bedroom for each dwelling unit Mr Dominguez testified that his family needs 3 bedrooms because they have a son and a daughter He further testified that the subdivision would have no value or use to him if a third bedroom cannot be pro vided Mr Dominguez also testified that the proposed 15 foot rear yard would be adequate for himself and his family 9 Applicant has filed to carry his burden of proof In regard to the requested rear yard variance 10 Applicant has made no showing as re quired by NJSA 70c (1) that re lief is necessary by reason of (a) excep tional narrowness shallowness or shape of the property (b) exceptional topo graphic conditions (c) unique physical features or (d) an extradinary or excep tional situation uniquely affecting the property or the structures lawfully exist ing thereon 11 To contrary applicant's reasons for seeking variance relief are purely per sonal and are entirely unrelated to any unique physical condition of the property 12 Applicant has made no showing that strict enforcement of the rear setback re quirement would cause undue hardship or peculiar and exceptional practical dif ficulties Clearly strict enforcement of the setback will not deprive Applicant of all reasonable use of the land Nor has Applicant shown that the setback re quirement will unreasonably limit nor mal use of the property Applicant has not shown that a conforming dwelling would be unmarketable or unfit for its in tended propose 13 Indeed Applicant has not even shown that the rear setback requirement pre cludes the construction of three bedroom dwellings for his sons Based on the evi dence presented Applicant has made no effort to design a conforming building that would include either (a) two three bedroom dwellings or (b) one three bed room dwelling for his son and one two bedroom dwelling for rental purposes To the contrary Applicant has shown only that his preferred floor plan for a three bedroom dwelling cannot comply with the rear yard requirement This is simply not a sufficient basis for the granting of variance relief 14 Applicant has made no showing as re quired by NJSA 70 (2) that granting the requested rear yard vari ance for this particular property would advance the purposes of the Municipal Land Use Law and that the benefits of the variance would substantially outweigh any detriment Applicant has clearly not shown that variance relief Is essential to allow families with children to reside on the property As noted above Applicant has shown only that variance relief Is es sential to allow construction of the three bedroom dwellings of his choice urther even if Applicant were able to show some benefit there has been no showing that any benefit would substantially outweigh the resulting unavoidable intrusion upon the light and air of neighboring proper ties 15 inally applicant has failed to carry his burden of showing that the requested relief can be granted without substantial detriment to the public good and zoning ordinance The Board is per suaded that the requested rear yard vari ance would result in homes that are sub stantially deeper than other homes in the area and that the proposed construction would interfere significantly with the light and air of adjoining properties The Board is also satisfied that granting re lief on the record presented here where relief is unrelated to any unique condition of the property would seriously under mine the intent and purpose of the newly adopted rear yard setback requirement 16 The Board is sympathetic with Appli cant's desire to provide decent safe housing for his two sons and their fami lies The Board is not convinced however that this goal can be accomplished only by duly Intruding upon the light and air of surrounding properties and unjustifiably undermining the purposes of the rear yard setback requirement 17 The requested rear yard variance should therefore be denied NOW THEREORE BE IT RESOLVED that this application by Claudino Dom inguez for minor subdivision approval for Block 128 Lots 32 and 33 and for vari ance relief allowing for each lot a foot overhang projection into the required front yard and a total projection of 9 feet into the required front yard by uncovered steps be and hereby is granted subiect to the following conditions: 1 Compliance with all applicable Town County State and
