Lewis argued that, if the jurors believed Grey should be convicted, it should be a verdict of third-degree murder, not first-degree murder. A defendant may be convicted of first-, degree murder if there was malice and premeditation involved in the killing. It carries a mandatory sentence of life in prison.

Malice is required for third-degree murder, but not prior intent, and it carries a maximum sentence of 20 to 40 years in prison. With confessions from Grey and Johnson, Thomassey said, that means only one other person was in the car. Thomassey presented six wit-' nesses who said Currington was a half- mile from North Charles Street and Shelton Avenue when the shooting occurred. The attorney said the two women who said Cur- rington was in the car were mistaken. The jurors deliberated one hour last night before recessing.

The deliberations will resume this morning. By Ann Belser Post-Gazette Staff Writer The case of three people accused of fatally shooting a 19-year-old Northview Heights woman in May went to a jury last night. In closing arguments, Deputy District Attorney Kim Berkeley Clark told the Common Pleas Court panel that in order to live up to its duty, the jurors had to convict Edward Walls, the son of two Pittsburgh police officers, who was seen firing the gun that killed Torie Jones. Walls, 16, of the North Side, is one of three defendants on trial before Judge Kathleen A. Durkin.

Also charged with homicide are Michael Curnngton, 22, of the North Side, and Anthony L. Grey, 15, of Homewood. A fourth defendant, Rodney Johnson, 19, of Northview Heights, will be tried separately. Walls is the son of Officer Nancy Turner and retired police Sgt. Edward Walls.

Clark said testimony showed that Walls was the person who pointed the gun out the window of a stolen car May 25 and fired into a group of teen-agers who had gathered in a yard off of Mount Pleasant Road. apparently fled the scene before going on his own to Mercy Hospital. Maiolo and the 17-year-old, whom officials would not identify, were released after treatment there. "It's surprising that only one bystander was hit," Fadzen said. "To have 10 bullets in that close space that's a lot of firepower." Mary Fat Werry, owner of Triangle Cafe on Amanda Avenue, which intersects Bausman, said she and her customers heard the gunfire and ran to the window to see what was happening.

"There was total chaos. There were kids everywhere, kids and cops everywhere," she said, estimating that there were about 100 people in the vicinity. She said there had been istfights in the area before but never any shootings. While four men have been charged in the case, most of the witnesses, including a city Housing Authority officer, said there were only three people in the car.

Williams and Patrick J. Thomas-sey, who is representing Curnngton in the case, each argued to the jurors that if they believed there were three people in the stolen car, their client wasn't one of them. Grey has confessed that he was riding in the car during the shootings. His attorney, John Lewis, Airbrake Turtle Creek. Jones, of Northview Heights, was struck by a single bullet in the back of her head and died. Clark said the occupants of the car endangered countless other people as they raced through North-view Heights and around the North Side, firing into crowds and at police cars. When their car crashed at North Charles Street and Shelton Avenue, Walls stumbled out of the car, then came up firing at the officers, Clark said. Walls was shot in the left knee during the gunbattle. "It's somewhat of a miracle that no one else was seriously injured or killed," Clark said.
