VI and the condition laid down were that she was to load a cargo of deals and boards at Montreal and Quebec and also at any one place between the two ports It was alleged that the defendant Mr Fry arranged a charter for the vessel to call at two places between Montreal and Quebec thereby causing additional expente to the owner who on the understanding that the vessel was to call only at one intermediate port had agreed to the rate of 45 per ton The steamer arrived at Sharpness two day late with the result that further expenses were incurred For the defence it was submitted that the plaintiff had been lubjected to no disadvantage by reason of tho ship having called at an additional port aud that in fact the circumstance of the ease showed that the charter which had been effected was of advantage to the firm Mr Allan member of the plaintiff firm gave further evidence in support of the claim and in cross-examination he stated that the demurrage at 6d per registered ton amounted to £30 a day Mr Bateson in opening for the defendant submitted that the plaintiffs had suffered no loss under the charter and that in any view of the circumstances they were asking the court to put them in a better position than they would nava occupied if the defendant had waited to get them a charter to call at one instead of two Other places If at all plaintiffs were only entitled to nominal damages At the time of this transaction charters were very difficult to get and one of the kind required by plaintiffs was not obtainable just then Mr Edward Carev Fry senior partner of Messrs Fry and Co of Quebec and Lloyd's Agont since 1856 stated that on the 20th June he received a cable from his brother at Liverpool with regard to the steamer Dimeric The form of charter-party used in this case was the usual one and under clause 3 the cargo was to be supplied to tho ship at not less than 100 standards per day That was written in but it was the usual form and was inserted in writing to prevent any ambiguity It was the equivalent of the customary despatch clause and was applicable to all sorts of steamers At the time witness received the message on the 20th the Dunerio was due He went to ascertain the condition of the market and found that it was very diffioult to get a charter There was only thi one open and the rate of 45 per ton vat the best that oould be obtained The tendency of the freight market at that tim was downward very strongly downward and if he had not taken the charter for Montreal and other ports the vessel would have lain some days In cross-examination witness admitted that he had chartered the vessel for Montreal and two other ports in defiance of instructions from Liverpool Mr Vry the defendant said he entered into negotiations for this charter and he admitted that he made mistake as to the places He oould not get a single bid for her at the time as not a single charter from the St Lawrence came under his observation Hi Lordship asked what became of the timber trade of the St Lawrence during those months Witness said it fell away altogether At that particular time from the 18th to the 25th June he found it almost impossible to get a steamer at any price because the stocks were depleted Witness did very large North American business After hearing counsel on either tide His Lordship reserved judgment until confer-enoe on the question in Manchester there has been a growth of the feeling that no good will be done until a competitive line of steamers is started This would involve a capital outlay of large sum and we have been making inquiries with a view to ascertaining what attituda tha leaders of the operatives in the manufacturing branch of the ootton trade ar likqly to adopt in the event of their organisation being asked to take soma of the financial responsibilities in connection with the establishment and maintenance of such a fleet In the absence of any scheme there was a disinclination on the part of certain gentlemen to discuss tn matter though the present evil was freely admitted and the impression conveyed was that if sunh a proposal wore submitted it would take great deal to persuade some of them to advise the operatives to risk their money in such an undertaking Recent events have shown tha importance of trade unions accumulating large reserve funds said one gentleman if (Cd 1004) of six pages was issued on Saturday containing the terms of the convention between the United Kingdom and Persia extending the system of telegrapnio communication between Europe and India through Persia The convention was signed at Teheran on May 16 1901 and the ratifications exchanged at Teheran on January 13 last It provides that in addition to the present line of telegraph from Teheran to Bushire and submarine cable thence to India already established in virtue of pre vious treaties a three-wire line of telegraph should be constructed by the Persian Govern ment from Kaahan to the Baluchiitan frontier via Vezd and Kerman traversing wherever pos sible inhabited districts The line is to be built under the direction and supervision of the British Telegraph staff now controlling th international line in Persia The Persian Government agrees to lease the use and the transit revenue of the line which is its property when complete to the Indo-European Telegraph Department at a rental of 4 per cent oti the capital expended on it construction three-quarters of such rental to be retained by tho British Government to recoup them for the advances made and one quarter subject to a minimum of 25000f to be paid annually to the Persian Government in two half-yearly instalments It ia understood that should the Persian Govern quarter share of tho rental exceed 25000f such excess should belong to the Persian Trea-The maintenance of the line including Ury ment of the lme guard who mut be Palaian subjects shall remain in the hands of the British director and
